Butler, Pierre Regnier, Michael Sirian The minutes of the May 8, 1973 meeting were approved as submitted 35-73-H 107 Virginia Marianna Sulikowski _. sy Floyd Unruh PRIOR HEARING�� May 8, 1973 SUBJECT Request to extend waiver to proposed new owner APPEAR�ICE M�arisnna Sulikawski, Floyd Unruh, Douglas Olson PROCEEDINGS Mr. Wozniak explained the variance was granted to Mrs. Sulikowski for hardship r�asons � as long as she owned the property and as far as he were concerned there wauld have to ba strong and compelling reasons to continue the variance to the new owner. Mr. Uaruh said Mrs. Sulikowski thinks there is a hardship because she is a widow and is no longer able to maintain the buf.lding; he said he feels the taaintenance of the building will improve with the new uwner. _ _ __ Meeting No. 90, S/22/73 continued ?. , _ get � Mr. ti'azniak asked if r4rs. Sulikowski couZdn�t. / - someone to take over the management of the bui2ding and Mr. Unruh said this could be done but it would take all of the profit. He explained this is a three story tu ilding, some work like the painti�g �as._ - to be done and she's not able to do it. He further explained that gursuant to the direction of the Board he tried to get a reasonable and substantiai b�xyer who wou 2d come forth with a substantial dQwn payment and this he has done in Mr. Olson. Mr. Unx�uh said the property brings in $1,000 a year in taxes, there are ten units (most of them one room) and the tenants are single gentlemen. Mr. Olsan said he was led to believe the granting of the waiver would not be this difficult. Mr. Wozniak explained the only reason the Board can grant a waiver is on hardship and the only consideraL�on is the comfort and welfare of the men who live there; the Board cannot be expected to grant a hardship waiver and be expected to keep granting it for re-sale purposes. Frank Staffenson said the last complaint was late 1970 and Mr.Unruh explained the tu i2ding was in the process of remodeling and that the wiring has been completed and two new water hezters have been instal2ed. He furt�er explained why it wau ld be impractical to convert the building to a four plex or to a rooming house. Mr. Olson said he would not be i�terested in purchasi�g the property as a boarding house and Mrs. Sulikowski said tha tenants are happy theze and if the Board wanted she would get statements from the tenants to that effect. Frank Staffenson said there would be no way of pred�cting who the tenants might be in the future and this would be a perpetuation of a waiver. ACTION NDrma Sommerdor� moved this the waiver be granted to these new owners only because of the hardship to Mrs. Sulikowski requiring her to own it and for the kind of tenancy that now exists and only foz the Iength of time these new owners own the property and further that these new owners follow the waiver as the original waiver granted to Mrs. Sulikowski. Mr. Englund said he wants to live in the basement in order to p�otect the propertq (the basemenC being the on2y partion of the property under condamnation) and he said this is necessary because of th� damage done to the premises when he has not been tnere to protect it. Butler SUB.IECT Appeal of certain Code requ irements APPEARANCE Rosalie L. Butler - _ PROCEEDINGS Mrs. Butler said her building covers 27.85 percent of the ground area which is considerably below the maximum limitation of 35 percent. She said Mr. Frank Staffenson came out to the "Carriage House" and determined it is 15 perceat short on light and ventilation in a large room scheduled to be a living room. She continned it is her intention to take the window of the room out and put in sli.ding g�as� doors which would correct the deficiency. She added the estimates have been reeeived tu t she wasld like a waiver granted to allow her one year to make the needed change. She said the reason for the waiver request is that the estimates received are considerably higtcer than she expected. Mrs. Butler noted that the cod� requirement indicates she must have a minimum of four £eet of sideyard space arid there is onlq one foot on the alley; she requested a life-time variance on the three f oot deficiency for the life of the structure. The chairman, Mr. Wozniak, noted the Board of Appeals generally grants sideyard variances and �he Building Department takes care of them. Boarrl member Norma Somaerdorf asked a question about what appeared to be a permanent separation existing on the surveyor's certificate between the existing house and what is referred to on the surveyor�s certificate as a garage. Mrs. Butler replied the garage is the Carr�age House im qu estion and it has received its own address from the Public Works Department and is to be known as 24 South Oxford Street. She continued the Carriage House is in complete code for wiring, plu mbing, room sizes; everything. She said the only thing she lacks is Che three feet on the distance batween the Carriage House and the alley. ACTION Mr. Wozniak. moved the requ est for variance on the sideyard setback be granted for the life time of the structure. A representative of the Building Bureau said a difference of opinion exists between the Bureau and Mr. Kroiss and Mr. Woxniak said there can be no decision until the differences between the two parties are resolved.
