Dear Sir:
This is written in response to the petition of Robert and Richard Steiner
to rezone from "B" Residence to Light Industrial property located on the north
side of York between Terrace and Westminster. This property is further described
as: North 1/2 of Lots 1 and 2, Block 5, Bdmund Rice�s 4th Addition.
This matter was heard at a public meeting of the Zoning Board on March 1,
1973, at which time the staff disclosed that the Bureau of Valuations stated a
county ice arena was definitely planned for the area north of the subject site.
The sponsor's attorney stated that the property fronting on York Street
is zoned Light Industrial and that they simply want to extend the zoning to
encompass the entire lot owned by the sponsor of the petition. He presented a
site plan for the proposed use which showed an extension of the parking lot and
landscaping for much of the remaining area with no specific use.
Several residents of the area appeared saying they don't oppose the
parking lot, but do oppose an industrial use.
As the Board discussed this matter, it was stated that if the property
were rezoned, not only could a parking lot be put in, but also any light �
industrial use. A motion to recommend denial failed for lack of a second, as
did a motion to recommend approval. A motion to lay over the matter for thirty
days for more information was seconded but failed for a lack of a majority vote.

A. SUFFICIENCY: In a letter dated February 6, 1973, the Department of Finance
declared the petition sufficient with the owners of 15, or 75% of the
eligible parcels having signed the petition.
B. HISTORY: There is no zoning history for this site.
C. PROPOSED TTSE: The petition declares the proposed use to be additional
parking for the maintainance company adjoining the site.
D. FRONTAGE AND AREA: The site has a frontage of 143.5 feet along Terrace
Street and 308 feet along Sims Avenue for an area of 44,198.00 sq. ft.
E. AREA ZONING: Heavy Industrial zoning encompasses railroad property south
of the site and west of I-35E. A thinner strip of Light Industrial zoning
borders the Heavy Industrial district south of the subject site.
Specifically, Light Industrial zoning exists south of York, west of Terrace
and adjoining the subject site arong its southern edge. A Commercial
district exists on the northeast corner of York and Westminster. The
general area north and east of the site is "B" Residential.
F, COMPREHENSIVE PLAN: e Com rehensive Pla alls for high density residential
use of the subject site and the ivanediately surrounding blocks north of York.
It calls for a collector street to run from York Avenue at Terrace Street
and then in a southeasterly direction along the bank north of the railroad
tracks. It calls for Westminster and Mississippi to be collectors as well.
It reco�ends limited industrial use south of York Avenue.
G. SITE CONDITIONS: The site is vacant and generally flat but there is a slope
upward of about 15 to 20 feet at its eastern edge and the remainder of the
site slopes very slightly westward toward Terrace Street. The site had
been used by the Highway Department for fill during construction of the
interstate.
H. AREA CONDIa ONS: Terrace Street and Sims Avenue are unbuilt next to this site.
Adjoining to the south are Marsden Building Maintenance Company and a light
manufacturing company. South of York is vacant land followed by railroad tracks.
West across unimproved Terrace St. is vacant land and further, Mississippi St.
and the interstate. Northward is vacant land to Case Ave, beyond which are
