Attached is a resolution for Council action, and my accompanying report
to the Mayor and Council, which resolution is for the purpose of directing
and authorizing execution of a purchase agreement and subsequent purchase
of a parcel of land for the subject pro�ect.
This office has obta.ined this agree�ent with Gordon Holmdahl pursuant to
Administrative Order No. D-589, dated April 30, 1973, for the sale of his
property to the Gity for compensation in the amount of �39,500.00.

Ladies a.nd Gentlemen:
�he Mayor of the City of Saint Paul by his order, Administrative Order No.
D-589, dated April 30, 1973, authorized and directed th�t the Bureau of
�aluations proceed with the action necessary to complete the acquisition of
the property located at 1407-09 Ea.st Hayt Averrue, whieh property is necessary
for tM.e Frost Lake Recreation Site, (7p�ra Space I,and Project No. Minn. OSA-
129 (DL).
Fursuant to such authorization and direction, T, i� my capacity as City
Valuation En�ineer, have secured. an agre�ment with Gordon a. Holmd.ahl and
Beth A. Holmdahl, his wife, and Alma Holmdahl, awners and sellers, for pt�r-
chase of, their land fbr compensation in the amount of �39�5�0.00, which in rr�y
opinion is a fair and reasonable price. Therefore, it is recommended to the
Council that it authorize the purchase of this property in lieu of condemnation
at the price of $39,500.00 as negotiated with the owner.
The property herein recormnended to be acquired is more particular]�y de�cribed
in the resolution submitted herewith for your consideration and action.

IT IS AGREED by and between City and Sellers as follows:

the mutually agreed upon consideration of the sum of T'hirty-nine Thousand

2. The above cor�sideration shall be paid to the Sellers 'by the City
upon delivery to the City of maxketable title and warran�y deed conveying
fee si.mple absolute title to the above--described real �state tYee and elear
of all encw�abrances� provided, ha�rever, that the City sha.11 retain the aum
of One Thousa.nd and no�100 DolJ.ars ($1,000.00) until all the rm�aining terms

5. In the event the Sellers do not deliver posaession of the pre�isea

shall pay to the City a monthly rental of the sum of Two Hundred and Forty-
five Dollars ($245.00).
6. It is agreed by and between the parties hereto tha.t if the 3eller:
do not comply with the conditions set out in Paxagraph 4 pertaining to the
wrecking and removal of the dwelling and delivery of possession by December
31, 1973, the City shall be entitled to retain the sum of One Thousand and
no�100 Dollars ($1,000.00) and the City would be authorized to'enter upon �
the premises and �►reck and remove the dwelling at �the City's expense. Notice
of such action to be te.ken by the City �hall be given in writing to the
Sellers at least thirty (30) days prior to the City's entering upon the land
and wrecking the building.
7. The Sellers shall, during the term of their occupancy of' such real
property, maintain insvrance proteetion covering the premises and protecting
the same against e�ll los�sea, damage8 or claims t�rhatsoever and shall provide
the City with a certificate of insurance prior to the transfer of title as
contemplated. in Paragraph 2 hereof. In a.ddition to the above insurance .
� coverage and during the tera of oecupancy by the Sellers contemplated herein,
Sellers sha11 m�,intain, at their an�m expense, public liability insurance pro-
tecting the�selves and the City of Saint Paul as �oint insureds f�om claims
for damages and bodi�y in�ury, including accidental death, as vell as f`rom

In addition to the purchase bid amount, the Purchaser shall_ be
required to simultaneously deposit with the City of Saint Paul
a work p�rformance sum of $1000.00. This d�posit shall be re-
�.ained by the City until �.he satisfactor�r completion of the
tilling and sitework described in Section 3 is accomplished, at
which time the entire performance sum shall be refunded to the
Purchaser. The Cit.y of Saint Paul reser.ves the right to p�rform
this filling and sitework should such work not. be completed within
the time limit specified in Secti6n 1. 1. In the event th� City
does perform this work due ta the failure of completYOn on the
part of the Qurchaser the sum of $300.00 shall be forteited to
the City of Saint Paul.

Upon completion of the remov�l, �illing and sitework, the
Purchaser shall notify the City Architect in writing that the

Should the purchaser not commence the removal ��ork nor" securely
board-up the vacant st.ructure within the specified five (5) day
period after receiving a written notice to prace�d: i.he City of

$1000. 00 peXformance sum.

D;�ILLLING REMOVAL '
2.1 REMOVAL OF STRUC^Ul?L
The Purchaser as soon as he recei.ves the notice to proceed with
the ti�ork, �hall ent^r u.pon t.he premises and do any and all
things n�ce�sary to pr:i�ct the pr�;nises fram damage by persons
who are unaut.hori��d to carry on t.he removal work. The struc-
ture shall be mov�.d in a prop?r and approved manner.
Moving opera�.ions shall be carried on by able, skilled crafts-
men, using equip:n�nt. �:hich provides adequate safet.y in trans-
porting the structures. The Purchaser sha1l pay all •fees and
obtain all permits requir.ed for his operations.
The Purchaser shall obt:ain the approval from the St Paul Citv
Architect for the Ic�at.ian of the new s�.t.es ,where the struc�
ture i� to be reiocated, if within the St.~�aul City limi�.s,
before any moving operations are started. The location of the
dwelling on the new 2ot shall comply with the St. Paul City
Building Code regulations.

The Purchaser shall rc*nove foundation wa11.s to an eleva�.ion of
not I.ess than (3) three £eet below t.he leve]. of the abutting
grour.d lin?. The Purchaser shall remove all basement columns,
partitions, and partition walls to the level of t.he basement
floor. The Purchaser shall remove all piping, conduit, heating
facila.ties, tar:lcs, furniture, rubbish, combustible materials,
etc. from t.he basement evcavations. The Purchaser shall break
up the basement and garage floor slabs into pieces not over o:e
(1) square yard in area and leave in pZacs.
The Purchauer shall remove from the premises a11 slabs, clothes
poles, steps, walks, miscellaneous concr��e, trash, junk and
debris�. Tne Purchaser must not use �.his area to dispose of
any trash or debris.
2.3 PUBLIC UTILITIES "
The Purchaser shall take care ot a12 public utila.t.ies encountered
during the progress of th4 work. He shal.l sFnd �roper notices,
make the necessary arranger��nts �nd pr.avi.de all services rc-
quired to take care of gas mains, water pip?s, sew�r pipes,
electrical wires, telephone and tel.egraph conduit and cables,
