WEiEREAS, pursuant to resolution, C.F. No. 260917, approved
March 26, 1973, a public hearing was duly held ori Apri1 12, 1973
before the Council of the City of Saint Paul, said hearing per-
taining to the condition of the structure located at 141-143
York, Saint Paul, Minnesota; and
WHEREAS, upon the facts presented at the said hearing
eonsisting of photographs, inspection reports and the recommenda-
tions of the Building Department it is found and determined by
the City Council that according to the records and files in the
office of the Register of Deeds, the last record owners of the
above described property are Shirley N. Bailey and Duane Bailey
and Minneapolis Federal Savings and Loa� Association is the
mortgagee, and that there are no other lien holders of record;
and that it is further determined that the above described building
constitutes a hazardous building within the definition of
Minnesota Statutes Section 463. 15 for the following reasons:
a.. The building is standing vacant, abandoned

are dilapidated. Most of the windows are broken
and pieces of siding are missing. The house has
settled out of level;
c. The interior condition of the building is
as follows: The six rooms on the first floor have
been vandalized. The doors have been torn ofP their �
hinges. The plaster is loose and broken and the
stair railings are broken off. The eight rooms on
the second floor have been vandalized. The plaster
is loose and missing. Doors have been torn off
their hinges. The plumbing, electrical and heating
systems have been disconnected;
d., The bu�ilding in: the above condition is beyond
reasonable r���.ir;
e. The building is unfit for human habitation in
its present condition and the above corrections must
be made in compliance with the Building Code and the
Housing Code of the City of Saint Paul in order to make
the same habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical damage, dilapidation and inadequate ma.intenance;
now, therefore , be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of
the City Council, the Council of the City of Saint Pau.l does hereby
make the following Order:
ORDER
1. The owners of the above described building shall make the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the office of the Clerk of the District Court of Ramsey
County, -Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Sum�.ry Enforcemen� of this

the Ramsey County District Court;
3. In the event th:at the building is to be razed by
the City of Saint Paul pursuant to judgment of the �istrict
Court, all personal property or fixtures which may unreasonably
interefere with the razin and removal of this building shall __
be removed within ten (10� days from the entry of judgment; and if
not so removed, the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other taxes; and be it

Honorable Council:
The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structure at the
location referred to above.
The owner of record is Shirley N. Bailey.
The legal description of the property is Lot 19, Block 3 , Ed Rices
Third Addition.
The building is a 2 story frame duplex.
This structure is in very poor condition. The outside stairways
and the porches are dilapidated. Most of the windows are broken
and pieces of siding are missing. The house has settled out of
level.
The six rooms on the first floor are vandalized. Doors have been
torn off their hinges. Plaster is loose and broken and the stair
railings are broken off.
The eight rooms on the second floor have been vandalized. Plaster
is loose and missing. Doors have been torn off their hinges.

This property is not in an area in which the Housing and Redevelop-
ment Authority is interested.
This building has been boarded by the city since February 23, 1973.

Mr. Gordon Kuschel, the owner of 137 York states that his in-
surance has been canceled because of the condition of this
structure.
Inasmuch as the physical damage and dilapidated conditions out-
lined above constitute a public hazardT and the owner has made
no attempt to satisfactorily repair the daznage despite our warn-
ings, and the continued vacant and boarded up condition contri-
butes a blighting influence on the neighborhood, it is the re-
commendation of this bureau that this matter be referred to the
City Attorney's office for razing and removal through District
Court proceedings.

chimney at the rear needs`repairs. The roof and
window trim have signs of dry rot;
d. The building in the above condition is
beyond reasonable repair;
