WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated December 11, 2001; and
WHEREAS, this order informed the then l�own interested or responsible parties that the structure
located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEKEAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by December 26, 2001; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Legislafive Heazing Officer of the City
Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the
public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, Febnxary 12, 2002 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties to
make the Subject Properly safe and not detrimental to the public peace, health, safety and welfaze and
remove its blighting influence on the community by rehabilitating this structure in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the structure in
accardance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed within five (5) days after the date of the Council Hearing; and
WI3EREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 27,
2002 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced
public hearings, the Saint Paul City Council hereby adopts the following Findings and Order conceming
the Subject Property at 1022 Stinson Street:
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00}.
That fliere now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties
to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Properiy which
declares it to be a nuisance condition subject to demolation.
That this building has been routinely monitored by the Citizen Service Offices, Division of
Code Enforcement, Vacant/Nuisance Buiidings.
8. That the l�own interested parties and owners are as previously stated an this resolution and
that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties sha11 make the Sub}ect Properiy safe and not
detrimental to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ardinances, or in the altemative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within five (5) days after the date of the Council Hearing.

1 1. The above referenced interested or responsible parties shall make the Subject Properiy safe and not

2. If the above corrective action is not completed within this period of time the Cirizen Service Office,
Division of Code Enforcement is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and charge the costs incurred against the Subject
Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
property or fixtures of any kind which interfere with the demolition and removal shall be removed
from the property by the responsible parties by the end of this time period. If all personal property
is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.
4. It is fiirther ardered, that a copy of this resolution be mailed to the owxers and interested parties in
accordance with Chapter 45 of the Saint Paul Legislative Code.

The meeting was called to order at 10:04 a.m.
Resolution ordering the owner to remove or repair the building at 774 Capitol Hei�hts. If
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.

Steve Magner reported the building was condemned in October 1996 and has been vacant since
November 1996. Twenty summary abatement norices have been issued to secure the building,
remove refuse, remove snow and ice, cut ta11 grass, and abate vehicle. On May 21, 2001, an
inspecrion of the building was conducted, a list of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building
was issued on June 8, 2001, with a compliance date of June 25, 2001. As of this date, this
properry remains in a condition which comprises a nuisance as defined by the legislative code.
Vacant building fees have been paid. Real estate taxes aze paid. Taxation has placed an
estimated mazket value of $6,100 on the land and $61,700 on the building. On August 14, 2Q01,
a code compliance inspection was done. Three bonds have been posted and forfeited. A fourth
bond was posted on January 23, 2002. Code Enforcement o�cers estimate the cost to repair is
$40,000; estimated cost to demolish, $12,000 to $14,000.
Gercy Strathman granted the owner six months to complete the rehabilitation of the properry.

the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.

Steve Magner reported this building was condemned in January 2000, and has been vacant since
Mazch 1, 2000. Twelve summary abatemexrt notices have been issued to remove refuse, secure
garage, cut tall grass, eliminate sink hole in front yard, remove snow and ice, and abate vehicle.
On October 23, 2001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance building was issued on October 31, 2001, with a compliance date of November 30,
2001. As of this date, this property remains in a condition which comprises a nuisance as defined
by the legislafive code. The vacant building fees aze due. Real estate taxes aze paid. Taxafion

has placed an estimated mazket value of $10,000 on ihe land and $63,500 on the building. On
February 5, 2001, a code compliance inspection was done. A$2,000 bond has not been posted.
Code Enforcement officers es[imate the cost to repair is $70,000 to $80,000; estimated cost to
demolish, $9,000 to $11,000.
Mr. Magner stated }us office has had no contact with the fee owners. Many people have called
from fl�e community looking to purchase the properiy. Mr. Magner had a phone call from the
mortgage company's attorney. A notice of the public hearing was faxed to that office last
Thursday.

Steve Magner reported this property has been vacant since November 16, 2000. Three summary
abatement notices have been issued to remove grass, remove snow and ice, abate vehicles. On
October 24, 2001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance condition was issued on Octoher 29, 2001, with a compliance date of November 28,
2001. As of this date, this properiy remains in a condition which comprises a nuisance as defined
by the legislative code. Vacant building fees aze due. Real estate ta�ces aze unpaid of $954.
Taacation has placed an estimated market value of $9,000 on the land; $28,400 on the building.
A code compliance inspection has not been applied for. A bond has not been posted. Code
Enforcement estimated the cost to repair is $50,000 to $60,000; estimated cost to demolish,
$6,000 to $7,000.
Mr. Magner stated his office has not heazd from the owners.

abatement has been issued to secure entry. On November 7, 2001, an inspection of the building
was conducted, a list of deficiencies which constitute a nuisance condition was developed, and
photographs were taken. An order to abate a nuisance building was issued on December 11,
2001, with a compliance date of December 26. As of this date, the properly remains in a

condition which comprises a nuisance as defined by the legslative code. The vacant building
fees aze due. Real estate t�es aze paid. Taa�ation has placed an estimated mazket value of
$10,000 on the land and $57,000 on the building. A bond has not been posted nor a code
compliance inspection done. Code Enforcement officers estimated the cost to repair is $100,000;
estimated cost to demolish, $8,000 to $10,000. The current owner is Ramsey County Tax
Forfeited Lands. They would like this building razed due to problems with it. They do not caze
to sell the building to the general public.
Mr. Strathman asked how this can belong to State of Minnesota Trust Exempt and have the real
estate faxes paid. Mr. Magner responded they zero out the taxes.

Scott Albright, 601 Park Street, appeared and stated he is one of the owners. He has owned the
property for approximately a yeaz. He posted the bond, and the fee has been paid.
Mr. Strathxnan asked what they aze planning to do. Mr. Albright responded they plan to
rehabilitate the property and rent it.
Mr. Strathman asked does six months work. Mr. Albright responded yes.
As stated on Page 1, Gerry Strathman recommends granting the owner six months to complete
the rehabilitation of the properry.

The Saint Paul City Council hereby makes the following order:

community by rehabilitating this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ardinances, or in the altemative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within five (5) days after the date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Cirizen Service Office,
Division of Code Enforcement is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and charge the costs incurred against the Subject
Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
property or fixtures of any kind which interfere with the demolition and removal shall be removed
from the property by the responsible parties by the end of this time period. If all personal property
is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.
4. It is fiirther ardered, that a copy of this resolution be mailed to the owxers and interested parties in
accordance with Chapter 45 of the Saint Paul Legislative Code.

The meeting was called to order at 10:04 a.m.
Resolution ordering the owner to remove or repair the building at 774 Capitol Hei�hts. If
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.

Steve Magner reported the building was condemned in October 1996 and has been vacant since
November 1996. Twenty summary abatement norices have been issued to secure the building,
remove refuse, remove snow and ice, cut ta11 grass, and abate vehicle. On May 21, 2001, an
inspecrion of the building was conducted, a list of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building
was issued on June 8, 2001, with a compliance date of June 25, 2001. As of this date, this
properry remains in a condition which comprises a nuisance as defined by the legislative code.
Vacant building fees have been paid. Real estate taxes aze paid. Taxation has placed an
estimated mazket value of $6,100 on the land and $61,700 on the building. On August 14, 2Q01,
a code compliance inspection was done. Three bonds have been posted and forfeited. A fourth
bond was posted on January 23, 2002. Code Enforcement o�cers estimate the cost to repair is
$40,000; estimated cost to demolish, $12,000 to $14,000.
Gercy Strathman granted the owner six months to complete the rehabilitation of the properry.

Mazch 1, 2000. Twelve summary abatemexrt notices have been issued to remove refuse, secure
garage, cut tall grass, eliminate sink hole in front yard, remove snow and ice, and abate vehicle.
On October 23, 2001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance building was issued on October 31, 2001, with a compliance date of November 30,
2001. As of this date, this property remains in a condition which comprises a nuisance as defined
by the legislafive code. The vacant building fees aze due. Real estate taxes aze paid. Taxafion

has placed an estimated mazket value of $10,000 on ihe land and $63,500 on the building. On
February 5, 2001, a code compliance inspection was done. A$2,000 bond has not been posted.
Code Enforcement officers es[imate the cost to repair is $70,000 to $80,000; estimated cost to
demolish, $9,000 to $11,000.
Mr. Magner stated }us office has had no contact with the fee owners. Many people have called
from fl�e community looking to purchase the properiy. Mr. Magner had a phone call from the
mortgage company's attorney. A notice of the public hearing was faxed to that office last
Thursday.

Steve Magner reported this property has been vacant since November 16, 2000. Three summary
abatement notices have been issued to remove grass, remove snow and ice, abate vehicles. On
October 24, 2001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance condition was issued on Octoher 29, 2001, with a compliance date of November 28,
2001. As of this date, this properiy remains in a condition which comprises a nuisance as defined
by the legislative code. Vacant building fees aze due. Real estate ta�ces aze unpaid of $954.
Taacation has placed an estimated market value of $9,000 on the land; $28,400 on the building.
A code compliance inspection has not been applied for. A bond has not been posted. Code
Enforcement estimated the cost to repair is $50,000 to $60,000; estimated cost to demolish,
$6,000 to $7,000.
Mr. Magner stated his office has not heazd from the owners.

abatement has been issued to secure entry. On November 7, 2001, an inspection of the building
was conducted, a list of deficiencies which constitute a nuisance condition was developed, and
photographs were taken. An order to abate a nuisance building was issued on December 11,
2001, with a compliance date of December 26. As of this date, the properly remains in a

condition which comprises a nuisance as defined by the legslative code. The vacant building
fees aze due. Real estate t�es aze paid. Taa�ation has placed an estimated mazket value of

compliance inspection done. Code Enforcement officers estimated the cost to repair is $100,000;
estimated cost to demolish, $8,000 to $10,000. The current owner is Ramsey County Tax
Forfeited Lands. They would like this building razed due to problems with it. They do not caze
to sell the building to the general public.
Mr. Strathman asked how this can belong to State of Minnesota Trust Exempt and have the real
estate faxes paid. Mr. Magner responded they zero out the taxes.

Scott Albright, 601 Park Street, appeared and stated he is one of the owners. He has owned the
property for approximately a yeaz. He posted the bond, and the fee has been paid.
Mr. Strathxnan asked what they aze planning to do. Mr. Albright responded they plan to
rehabilitate the property and rent it.
Mr. Strathman asked does six months work. Mr. Albright responded yes.
As stated on Page 1, Gerry Strathman recommends granting the owner six months to complete
the rehabilitation of the properry.
