WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City Council
to hold public hearings to consider the advisability and necessity of ordering the repair or wrecking and
removal of a two-story, wood frame duplex and the detached, two-stall, wood frame garage located on
property hereinafter referred to as the "Subject Property" and commonly known as 774 Capitol Heights.
This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or befare April 16, 2001, the foliowing aze the now known

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated 7une 8, 2001; and
WHEREAS, this order informed the then known interested or responsible parties that the structure
located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properiy by dune 25, 2001; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s} to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Legislative Iiearing Officer of the City
Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the

Council on Tuesday, February 12, 2002 to hear testunony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties to
make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition of the shucture to be

WHEREAS, a hearin was held before the Saint Paul City Council on Wednesday, Febmary 27,
2002 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the tesrimony and evidence presented at the above referenced
public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning
the Subject Properry at 774 Capitol Heights:
That the Subject Properiy comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then l�own responsible parties
to conect the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Division of Code En£orcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division of
Code Enforcement, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this resolution and
that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Properiy safe and not
detdmental to the public peace, health, safety and welfaze and remove its blighting influence on the
community by rehabilitating this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the shucture

2. If the above conective acrion is not completed within this period of time the Citizen Service Office,
Division of Code Enforcement is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the Subj ect
Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all personal
properry or fixtures of any land which interfere with the demolition and removal shall be removed
from the property by the responsible parties by the end of this time period. If all personal properry
is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.
4. It is fuither ordered, that a copy of this resolution be mailed to the owners and interested parties in
accordance with Chapter 45 of the Saint Paul Legislative Code.

The meeting was called to order at 10:04 a.m.
Resolution ordering the owner to remove or repair the building at 774 Canitol Heights. If
the owner faiLs to comply with the resolution, Code Enforcement is ordered to remove the
building.

Steve Magner reported the building was condemned in October 1996 and has been vacant since
November 1996. Twenty summary abatement notices have been issued to secure the building,
remove refuse, remove snow and ice, cut tall grass, and abate velucle. On May 21, 2001, an
inspection of the building was conducted, a Iist of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building
was issued on June 8, 2001, with a compliance date of June 25, 2001. As of this date, this
property remains in a condition which comprises a nuisance as defined by ihe legislarive code.
Vacant building fees have been paid. Rea1 estate taYes are paid. Taxation has placed an
estimated mazket value of $6,10� on the land and $61,700 on the building. On August 14, 2001,
a code compliance inspection was done. Three bonds have been posted and forfeited. A fourth
bond was posted on January 23, 2002. Code Enforcement officers estimate the cost to repair is
$40,000; estimated cost to demolish, $12,OQ0 to $14,000.
Gerry StraUunan granted the owner six months to complete the rehabilitation of the property.

March 1, 2000. Twelve summary abatement notices have been issued to remove refuse, secure
gazage, cut tall grass, eliminate sink hole in front yard, remove snow and ice, and abate vehicle.
On October 23, Z001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance building was issued on October 31, 2001, with a compliance date ofNovember 30,
2001. As of this date, this property remains in a condition wluch comprises a nuisance as defined
by the legislative code. The vacant building fees are due. Real estate taYes are paid. Taxation

has placed an estimated mazket value of $10,000 on the land and $63,500 on the buiiding. On
February 5, 2001, a code compliance inspection was done. A$2,000 bond has not been posted.
Code Enforcement officers estimate the cost to repair is $70,000 to $80,000; estimated cost to
demolish, $4,000 to $11,000.
Mr. Magner stated his office has had no eontact with the fee owners. Many people have called
from the community looking to purchase the properiy. Mr. Magner had a phone call from the
mortgage company's attorney. A notice of the public hearing was f�ed to that office last
Thursday.

abatement notices have been issued to remove grass, remove snow and ice, abate vehicles. On
October 24, 2001, an inspection of the building was conducted, a list of deficiencies which
consritute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance condition was issued on October 29, 2001, with a compliance date of November 28,
2001. As of this date, this properry remains in a condition which comprises a nuisance as defined
by the legislative code. Vacant building fees aze due. Real estate taxes aze unpaid of $954.
Taxation has placed an estimated mazket value of $9,OQ� on the land; $28,400 on the building.
A code compliance inspection has not been applied for. A bond has not been posted. Code
Enforcement estimated the cost to repair is $50,000 to $60,000; estimated cost to demolish,
$6,000 to $7,000.
Mr. Magner stated his office has not heazd from the owners.

abatement has been issued to secure entry. On November 7, 2001, an inspection of the building
was conducted, a list of deficiencies which constitute a nuisance condition was developed, and
photographs were taken. An order to abate a nuisance building was issued on December I 1,
2001, with a compliance date of December 26. As of this date, the property remains in a

compliance inspecrion done. Code Enforcement officers estimated the cost to repair is $100,000;
estimated cost to demolish, $8,000 to $10,000. The current owner is ltamsey County Taai
Forfeited Lands. They would like this building razed due to problems with it. They do not caze
to sell the building to the generai public.
lvu. Strathman asked how tivs can belong to State of Minnesota Trust Exempt and have the real
estate tta�es paid. Mr. Magner responded they zero out the taxes.

Scott Albright, 601 Pazk Street, appeazed and stated he is one of the owners. He has owned the
property for approximately a yeaz. He posted the bond, and the fee has been paid.
Mr. Sttathman asked what they aze planning to do. Mr. Albright responded they plan to
rehabilitate the property and rent it.
Mr. Strathman asked does six months work. Mr. Albright responded yes.
As stated on Page 1, Gerry Strattunan recommends granting the owner six months to complete
the rehabilitation of the properry. -

The meeting was called to order at 10:04 a.m.
Resolution ordering the owner to remove or repair the building at 774 Canitol Heights. If
the owner faiLs to comply with the resolution, Code Enforcement is ordered to remove the
building.

Steve Magner reported the building was condemned in October 1996 and has been vacant since
November 1996. Twenty summary abatement notices have been issued to secure the building,
remove refuse, remove snow and ice, cut tall grass, and abate velucle. On May 21, 2001, an
inspection of the building was conducted, a Iist of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building
was issued on June 8, 2001, with a compliance date of June 25, 2001. As of this date, this
property remains in a condition which comprises a nuisance as defined by ihe legislarive code.
Vacant building fees have been paid. Rea1 estate taYes are paid. Taxation has placed an
estimated mazket value of $6,10� on the land and $61,700 on the building. On August 14, 2001,
a code compliance inspection was done. Three bonds have been posted and forfeited. A fourth
bond was posted on January 23, 2002. Code Enforcement officers estimate the cost to repair is
$40,000; estimated cost to demolish, $12,OQ0 to $14,000.
Gerry StraUunan granted the owner six months to complete the rehabilitation of the property.

March 1, 2000. Twelve summary abatement notices have been issued to remove refuse, secure
gazage, cut tall grass, eliminate sink hole in front yard, remove snow and ice, and abate vehicle.
On October 23, Z001, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance building was issued on October 31, 2001, with a compliance date ofNovember 30,
2001. As of this date, this property remains in a condition wluch comprises a nuisance as defined
by the legislative code. The vacant building fees are due. Real estate taYes are paid. Taxation

has placed an estimated mazket value of $10,000 on the land and $63,500 on the buiiding. On
February 5, 2001, a code compliance inspection was done. A$2,000 bond has not been posted.
Code Enforcement officers estimate the cost to repair is $70,000 to $80,000; estimated cost to
demolish, $4,000 to $11,000.
Mr. Magner stated his office has had no eontact with the fee owners. Many people have called
from the community looking to purchase the properiy. Mr. Magner had a phone call from the
mortgage company's attorney. A notice of the public hearing was f�ed to that office last
Thursday.

October 24, 2001, an inspection of the building was conducted, a list of deficiencies which
consritute a nuisance condition was developed, and photographs were taken. An order to abate a
nuisance condition was issued on October 29, 2001, with a compliance date of November 28,
2001. As of this date, this properry remains in a condition which comprises a nuisance as defined
by the legislative code. Vacant building fees aze due. Real estate taxes aze unpaid of $954.
Taxation has placed an estimated mazket value of $9,OQ� on the land; $28,400 on the building.
A code compliance inspection has not been applied for. A bond has not been posted. Code
Enforcement estimated the cost to repair is $50,000 to $60,000; estimated cost to demolish,
$6,000 to $7,000.
Mr. Magner stated his office has not heazd from the owners.

was conducted, a list of deficiencies which constitute a nuisance condition was developed, and
photographs were taken. An order to abate a nuisance building was issued on December I 1,
2001, with a compliance date of December 26. As of this date, the property remains in a

estimated cost to demolish, $8,000 to $10,000. The current owner is ltamsey County Taai
Forfeited Lands. They would like this building razed due to problems with it. They do not caze
to sell the building to the generai public.
lvu. Strathman asked how tivs can belong to State of Minnesota Trust Exempt and have the real
estate tta�es paid. Mr. Magner responded they zero out the taxes.

Scott Albright, 601 Pazk Street, appeazed and stated he is one of the owners. He has owned the
property for approximately a yeaz. He posted the bond, and the fee has been paid.
Mr. Sttathman asked what they aze planning to do. Mr. Albright responded they plan to
rehabilitate the property and rent it.
Mr. Strathman asked does six months work. Mr. Albright responded yes.
As stated on Page 1, Gerry Strattunan recommends granting the owner six months to complete
the rehabilitation of the properry. -
