� WHEREAS, pursuant to resolution, C. F. No. 260667, approved
February 13, 1973, a public hearing was duly held on March 1,
1973 before the Council of the City of Saint Paul, said`hearing
pertaining to �he condition of the structures located at 405
Michigan, Saint Paul, Minnesota; and �
� WHEREAS, upon the facts presented at the said hear'ing con- ��
sisting of photographs, inspection reports and the recommendations
of the Building Department, it is found and determined by the
City Council that according to the records and files in th� office
of the Register of Deeds the last record owner of the above
described property is Robert L. Bernstein and that there are no
lien holders of record; and that it is further determined that
the above described buildings constitute hazardous buildings
within the definition of Minnesota Statutes Section 463. 15 for
the following reasons:
a. The buildings are standing vacant, abandoned
and are subject to beit�g entered by unauthorized persons;

b. The exterior condition of the building is
as follows: The limestone foundation has eroded mortar
joints and there are openings in that part of the
foundation above the grade. The roofing is in need of
replacement. Parts of the asphalt siding is damaged
and missing, exposing framing timbers. The Window
sash and frames have dry rot. The roof cornice has
dry rot. The lower portion of the structural framing
members have dry rot;
c. The interior condition of the building is
as follows: The interior of the house has been vandalized,
including the plumbing fixtures. Floors are sagging due
to rotting joists. Plaster walls and ceilings are in
need of repair. Floor coverings have been damaged;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in
its present condition and the above corrections must be
made in compliance with the Building Code and the Housing
Code of the City of Saint Paul in order to ma.ke the same
habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical dama.ge, dilapidation and inadequate maintenance;
g. The garage is in a state of disrepair. Siding
has been torn loose and garage doors are broken;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463.15 through 463.26, and based upon the foregoing findings of
the City Council, the Council of the City of Saint Paul does
hereby ma.ke the following Order: --- `�' "

1. The owner of the above described buildings shall ma.ke
the same safe and not detrimental to the public peace, health,
safety and welfare by having the said building and garage razed
and the materials therefrom removed from the premises within
thirty (30) days from the date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon th e City of Saint Paul and
filed in the Office of the Clerk of the District Court. of Ramsey

Order to raze and remove the said building and garage will be
made to the Ramsey County District Court;
3. In the event that the building and garage are to be
razed by the City of Saint Paul pursuant to judgment of the
District Court, all personal property or fixtures of any kind
which may unreasona.bly interfere with the razing and removal
of this building and garage shall be removed within ten (10)
days from the entry of judgment; and if not so removed, the
City of Saint Paul sha.11 remove and dispose of such personal
property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other taxes; and be it

Honorable Council :
The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structures at
the location referred to above.
The owner of record is Robert L. Bernstein.
The legal description of the property is Lot 23 except E. 26 2l3 ft
and Lot 22 except W. 26 2/3 ft, Block 1, Smith�s Addition to St. Paul.
The buildings are a single family dwelling and a garage.
This single family dwelling and garage located at 405 Michigan are in
deteriorated condition and should be wrecked and removed.
The limestone foundation of the house has eroded mortar joints and
there are openings in that part of the foundation above the grade.
The roofing is in need of replacement. Parts of the asphalt siding
is damaged and missing, exposing framing members. Window sash and
frames have dry rot. The roof cornice has dry rot. The lower por-
tion of the structural framing members have dry rot.
The interior of the house has been vandalized including the plumbing
fixtures. Floors are sagging due to rotting joist. Plaster walls
and ceiling are in need of repair. Floor coverings have been dam-
aged.
The garage is in a state of disrepair. Siding has been torn loose
and garage doors are broker�.
The Housing and Redevelopment �utizozity does not intend to acquire
this property.

The subject property has been boarded up by the owner since May 25,
1972 and by the city since October 19 , 1972.
Inasmuch as the physical damage, and the dilapidated condition
outlined above constitute a public hazard and the owner
has made no attempt to satisfactorily repair the damage despite our warning�
and the continued vacant and boarded up condition contributes a
blighting influence on the neighborhood, it is the recommendation of this
bureau that this matter be referred to the City Attorney`s office for
razing and removal through District Court proceedings.
