THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. For the purpose of this ordinance the terms defined herein shall have the � meaning subscribed to them as follows: "Maintenance" means and includes trim�ning, spraying, remonal and tree repair. Section 2. The Council sha11 each qear determine the streets on which trees shall be maintained together with the estimated a�unt of service charges to be levied against benefited property. Prior to such determination the City Council shall fix a date for public hearing, and the City Clerk shall cause to be published notice of such hearing in a legal newspaper at least twice no less than one week prior to such public hearing. The aotice shall state the date, time and place of such hearing and the estimate of the cost of such service to be charged against benefited property, setting forth the basis of such charge (front-foot cost or otherwise). Section 3. At such hearing the Couneil shall hear property owners with reference to the scepe and desirability of the proposed service and the method of collection of such service charges. The Council shall by resolution determine the services to be performed and shall authorize the doing of the work by the appropriate City department or agency. Section 4. The department and/or agency shall keep a record of the cost of services atrributiable to streets on which work is done, as determined by the City Council in Sectioa 3, aad shall report such information to the Department of Finance and Management Services. � Section 5. On or before October 1 of each year, the Department of Finance and Manage- ment Services shall notify the City Council of the total cost of services per- formed during the previous year and the portion of such costs to be assessed against each lot and parcel of property benefited from such service. Upon re- ceip t thereof, the Council shall bR resolution determine the amount of the total cost for such services that the City will pay, if any, other than the amouat which the City would pay as a benefited property owner, the amount and rates to be assessed, and shall fix a date for public hearing at which time the Council shall consider adopting and levqing the service charges. The date of public hearing shall be at least two weeks after adoption of said resolution. Section 6. Folln�ing the adoption of the resolution provided in Section 5 above, the Department of Finance and Management Services shall publish a notice of hearing at least twice in a dailq newspaper of the City, the last notice being published at least five daqs prior to the public hearing. The notice shall state the date, time and place of hearing, the purpose of the hearing, identifq the services pro- vided �d the property to be assessed a service charge thereof, and shall state the proposed rates of service charges to be considered by the Council. On the date of public hearing the Council shall meet to consider the adoption of the proposed service charges. The Eouncil shall hear all interested parties concerning the proposed charges. At such meeting or at any ad3ournment thereof, the Council may amend the proposed service charges, and shall, by resolution, adopt the service charges as a special assessment against the properties deemed benefited bq the service. Special assessments levied hereunder shall be payable in a single installment. SecCion 8. After adoption of the service charges and assessment rates th�refor, and no later than November 15, the Citq Clerk shall transmit a certified duplicate thereof to the Ramsey County Auditor to be extended on the proper tax list of the County and collected the following year along with current taxes. Section 9. Within twentq days after adoption of the assessment rnll, anq person aggrieved may appeal to the District Court in the manner set forth in Chap�er 14 of the City Charter. Section 10. This ordinance shall be deemed a part of the Saint Paul Administrative Code and shall be incorporated therein and given an appropriate chapter and/or section number at the time of the compilation of the said Administrative Code.
