single family dwelling known and
described as 909 Fremont Avenue in
the City of Saint Paul and situated
upon those premises legally described
as Lot 22, Block 92, Asch' s Subdivision
of Lyman Daytons Addition to Saint Paul,
according to the plat on file and of
record in the office of the Register of
Deeds in and for the County of Ramsey,
State of Minnesota.
WHEREAS, pursuant to resolution, C. F. No. 260567, approved
January 31, 1973, a public hearing was duly held on February 15,
1973 before the Council of the City of Saint Paul, said hearing
pertaining to the condition of the structure located at 909
Fremont Avenue, Saint Paul, Minnesota; and
WHEREAS, upon the fact� presented at the said hearing con-
sisting of photographs, inspection reports and the recommendations
of the Building Department, it is found and determined by the City
Council that according to the records and files in tYie office of
the Register of Deeds, the last record owner of the above
described property is Donald Kinney and there are no lien holders
of record; and that it is further determined that the above
described building constitutes a hazardous building within the
definition of Minnesota Statutes Section 463.15 for the following
reasons:
a. The building is standing vacant,
abandoned and is subject to being entered by
unauthorized persons;

b. The exterior condition of the building is
as follows : The aluminum siding is bent, dented and
badly damaged with some sections missing. The roof
cornice and mouldings are loose, have dry rot and some
pieces are missing. The window sills and trim have
dry rot and show signs of deterioration. The paint
is peeling and blistering, exposing wood trim to the
weather. The porch decks of the two front porches
are sagging badly. The porch windows are broken and
the sash has dry rot. The steps to the front door are
missing. The chimneys above the roof line have bricks
that are spalling and are deteriorated. The roof at
the northeast part of the house has collapsed due to dry
rot of the rafters and roof boards. There is evidence of
numerous roof leaks;
` c. The interior condition of the building is
as follows: Ceilings and walls have large areas of
plaster missing. Wood lath is exposed, broken and pro-
truding from the walls and ceilings. The finished floor
is badly cracked. Passage to the bathroom on the second
floor is through two bedrooms. The basement stairs are
in a dangerous condition. Stair stringers have dry rot,
improper support and are split. The concrete floor is
broken up with large areas of concrete missing. Leaking
basement plumbing has created an excessive moisture
condition. The basement ceiling joists are undersized,
over spanned and have dry rot;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in
its present condition and the above corrections must be
ma.de in compliance with the Building Code and the Housing
Code of the City of Saint Eaul in order to make the same
habitable;
� f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical dama.ge, dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of
the City Council, the Council of the City of Saint Paul does hereby
make the following Order:
ORDER
1. The owner of the above described building shall make the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order; .

2. Unless such corrective action is taken to comply with
th.is Order or an answer served upon the City of Saint Paul and
filed with the Office of the Clerk of the District Court of
Ramsey County, Minnesota, within twenty (20) days from the date
of the service of this Order, a Motion for Summary Enforcement
of this Order to raze and remove the said building will be made
to the Ramsey County District Court;
3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all personal property or fixtures which may unreasonably inter-
fere with the razing and removal of this building shall be removed
within ten (10) days from the entry of judgment; and if not so
removed, the City of Saint Paul shall remove and dispose of such
personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other taxes•, and be it
FURTHER RESOLVED, That a certified copy of �this resolution
and incorporated Order herein be served upon the last record
owners of the above described property in the manner provided
by 1aw.

The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structure at the
location referred to above.
The owner of record is Donald Kinney.
The legal description of the property is Lot 22, Block 92, Aschs
Subdivision of Lyman Daytons Addition.
The building is a 12 story frame dwelling.
This building is in a very deteriorated and dilapidated condition
and should be wrecked and removed.
The exterior is covered with an aluminum siding which is bent,.
dented, and badly damaged with some sections missing. Roof cornice
and mouldings are loose, have dry rot, and have some pieces missing.
Window sills and trim have dry rot and show signs of deterioration.
Paint is peeling and blistering exposing wood trim to the weather.
The porch decks of the two front porches are sagging badly. The
porch windows are broken and the sash has dry rot. The steps to the
front door are missing. The chimneys above the roof line have brick
that are spalling and are deteriorated. The roof at the northeast
part of the house has collapsed due to dry rot of the rafters and

ings and walls have large areas of plaster missing. Wood lath is
exposed, broken, and protruding from the walls and ceilings. The
finished floor is badly cracked. Passage to the bathroom on sec-
ond floor is through two bedrooms.

The basement stairs are in a dangerous condition. Stair stringers
have dry rot, improperly supported, and are split. The concrete
floor is broken up with large areas of concrete missing. Leaking
basement plumbing has created an excessive moisture condition.
Basement ceiling joist are undersized, over spanned and have dry rot.
The Housing and Redevelopment Authority does not intend to acquire
this property.
The subject property is being boarded by contract labor through
summary abatement procedures under ordinance number 15154 , Council
file 259368.
Inasmuch as the physical damage and the dilapidated condition out-
lined above constitute a public hazard and the owner has made no
attempt to satisfactorily repair the damage despite our warnings ,
and the continued vacant and boarded up condition contributes a
blighting influence on the neighborhood, it is the recommendation
of this bureau that this matter be referred to the City Attorney 's
office for razing and removal through District C rt proceedings .

Our office received a telephone call from Mrs. George Robinson,
901 East Third Street, regarding a vacant house at 909 Fremont.
The house is vacant and has been for approximately one month.
There are rats on the premises and they are migrating to
surrounding property. The house is structurally unsound.
Mrs. Robinson is urging that this structure be condemned and
torn down as it is degrading the neighborhood.

Note: Our office received two additional calls from neighborhood
residents stating the same as above, but they did not leave
their names. Frank Staffenson notified our office that
5-6 loads of rubbish were removed by a compactor recently
from the interior of the home. It is structurally unsound
and overrun with rats.
