WHEREAS pursua.nt to resolution, C. F. No. 260438, approved January 5, 1�73, a public hearing was duly held on January 18, 1973 before the Council of the City of Saint Paul, said hearing �., pertaining to the condition of the structure located at 82 Leech Street, Saint Paul, Minnesota; and WHEREAS, upon the facts_presented at the hearing consisting of photog�aph�, inspection reports and the recorrrt�endatians �f the Building Department, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the aboue de�cribed property is the Estate of Gyle M. Johnson, Alton V. Johnson, Administrator; and that there are no lien holders of record; and tha.t it is further determined that the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463. 15 for the following reasons: a. The exterior condition of the building is as follows: The front porch is in a weakened condition and in danger of collapse. Pieces of lap siding are missing. Two sets of exterior steps have been removed and one other set is in a dangerous condition. The north porch and stoop are in need of repair. Parts of the roof cornice and other trim are missing. The limestone foundation has eroded mortar joints; c. The interior- condition of the building is as follows: There are four rooms and bath on both first and second floors. Vandals have dama.ged the floors, walls, ceilings, and wood trim. The �windows have been broken. Plumbing and electrical fixtures have been destroyed by vandals. There is no central heating. An attached shed at the back of the dwelling has roof damage and the rafters are overspaned; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for human habitation in its present condition and the above corrections must be ma.de in compliance with the Building Code and the Housing Code of the City:, of Saint Faul in order to ma.ke the same habitable; --- f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its - physical damage, dilapidation and inadequate ma.intenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing Findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owner of the above described building sha.11 make the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze an.d remove the said building will be ma.de to the Ramsey County District Court; ! In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably inter- fere with the razin and removal of this building shall be removed within ten �10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes ; and be it FURTHER RESOLVED, That a certified copy of this resolution and incorporated Order herein be served upon the last record owner of the above described property in the manner provided by law. The owners of record are the Estate of Amelia H. Huspek and Mrs. Frank Johnson. The legal description of the property is W. 2 of Lot 14 , Block 7, Leech' s Addition. The building is a 2� story frame duplex. The exterior is in a �,eteriorated and dilapidated condition. The front porch is in a weakened condition and in danger of collapse. Pieces of lap siding are missing. Two sets of exterior steps have been removed and one other set is in a dangerous condition. The north porch and stoop are in need of repair.
