WHEREAS, pursuant to resolution, C. F. No. 260013, approv�. November l, 1972, a public hearing was scheduled for 10:00 a.m. on November 24, 1972 before the Gouncil of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 818 Ashland, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and the recommendations of the Building Department, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the above described property is Raymond J. Kroiss and that there are no lien holders of record; and that it is further determined that the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The exterior condition of the building is as follows: There is erosion of the mortar joints in the limestone foundation. The front and rear porches have dry rot throughout the framing and deck members. Window and roof trim have dry rot and pieces of trim are loose and some have fallen off. Many of the glass windows are broken. Gutters and downspouts are rusted; c. The interior condition of the building is as follows: A fire, which started on the first floor, did extensive damage throughout the rooms on both first and second floors. In some areas of the walls and ceilings of the first floor, the fire penetrated through the plaster into th e framing lumber. The heat from the fire has caused paint to blister on the wood trim and doors. Plaster is loose and falling due to fire and water damage. Electric fixtures and plumbing fixtures have been removed. Most of the wiring inside the frame walls is of knob and tube type; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for human habitation in its present condition and the above corrections must be ma.de in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to ma.ke the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate maintenance; now, therefore, be it RESOLVED, that in accordance with Minnesota Statutes Sections 463. 15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER l. The owner of the above described building shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the ma.terials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4. The owner of record is Raymond J. Kroiss. The legal description of the property is Lot 5, Block 2, Bryants Addition. The building is a two story frame single family dwelling 28' x 48' . There is erosion of the mortar joints in the limestone foundation. The extexior of the dwelling is in a deteriorated condition. The front and rear porchs have dryrot throughout the framing and deck members. Window and roof trim have dryrot and pieces of trim are loose and some have fallen off. Many of the glass windows are broken. Gutters and downspouts are rusted. A fire, which started on the first floor, did extensive damage through- out the rooms an both first and second floor. In some areas of the �ralls and ceilings of first floor, the fire penetrated through the plaster into the framing lumber. The heat from the fire has caused paint to blister on the wood trim and doors. Plaster is loose and falling due to fire and water damage. Electric fixtures and plumbing fixtures have been removed. Inasmuch as the inadequate maintenance, dilapidation and the con- ditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contri- butes a blighting influence on the neighborhood, it is the recom- mendation of this bureau that this matter be referred to the City Attorney's office for razing and removal through District Court proceedings.
