_ WHEREAS, pursuant to Resolution, C. F. No. 260103, approved
November 9, 1972, a public hearin� was duly held on December 7,
1972, before the Council of the City of Saint Paul, said hearing
pertaining to the condition of the structures located at 844 Dayto�
Avenue, Saint Paul, Minnesota; and -�

� WEiEREAS, upon facts presented at -th� said he�ring consisting
. of photographs, inspection reports and the recommenda�tions of the
Building Department, it is found and determined by the City Council
that according to the records and files in the office of the Register
of Deeds, the last record owners of the abo�e described property are
Robert Bigelbach �and Ernie an� Ruby Olson and that there are no
other lien holders of record; �and that it is further determined that
the above described buildings constitute hazardous buildings within
the definition of Minnesota, Statutes Section 463.,15 for the following
reasons;
a. The buildings are standing vacant,
abandoned and are subject to being ente�ed by
unauthorized persons;

b. The exterior condition of the building is
as follows: Dry rot exists throughout the exterior
wood members. Stairways to front and back doors are
in a dilapidated and dangerous condition. Evidence
of roof leaks occur throughout the building. Screens
are rusted through contributing to the unsightly
appearance. The porch ceiling boards are loose and
ready to fal l of f.
c. The interior condition of the building is
as follows: The interior has been vandalized. fihe
guard rail on the front stairway has been destroyed.
Wood trim has been removed. Doors have been torn
loose from their hinges. Many windows are broken
and the floor is warped. The guard rails of the rear
stairs from second to third floor have been removed
by vandals. The door frame at the bottom of the stairs
has been destroyed. Floor and floor covering ma.terials
are d�teriorated. The plaster is deteriorated and has
water da.ma.ge. The rooms on the third floor ha.ve loose
plaster and warped floors.
d. The building in the above condition is beyond
reasonable repair.
e. The building is unfit for human habitation
in its present condition and the above corrections must
be ma.de in compliance with the Building Code and the
Housing Code of the City of Saint Paul in order to ma.ke
the same habitable.
f. The building constitutes a nuisance and a
hazard to the public health, safety and welfare because
of its physical damage, dilapidation and inadequate
maintenance.
g. There is a •��2' x 18' frame garage at the rear
of the lot which is in a deteriorated condition. The
roof sheathing has dry rot, the roof covering is old and
in need of repair. The large doors have loose boards and
are in need of repair.

RESOLVED, Tha.t in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Pau.l does hereby

ORDER
1. The owners of the above described buildings shall
make the same safe and not detrimental to the public peace,
health, safety and welfare by having tYie said buildings razed
and the materials therefrom removed from the premises within
thirty (30) days from the date of the service of this Order;
2. Unless such corrective action is taken to comply
with this Order or an answer served upon the City of Saint Paul
and filed in the Office of the Clerk of the District Court of
Ramsey County, Minnesota, within twenty (20) days from the date
of the service of this Order, a Motion for Summary Enforcement
of this Order to raze and remove the said building and garage
will be made to the Ramsey County District Court;
3. In the event that the buildings are to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all personal property or fixtures which may unreasonably inter- '
fere with the razing and removal of this building and garage shall
be removed within ten (10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other ta�es;
FURTHER RESOLVED, That a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners Qf the abave described property in the manner provided by law.

Honorable Council:
The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structure at the
location referred to above.
The owners of record are Robert Bigelbach and Ernie and Ruby Olson.
The legal description of the property is Ex. E. 16 ' of Lot 5 -and
the [ni. 19 ' of Lot 7 and all of Lot 6 , Block 4, Nininger & Donnelly' s
Addition.
The building is a frame 3 plex with sleeping rooms, 38 ' x 52 ' .
Lack of required repair and maintenance has caused this structure
to be in a decayed and deteriorated condition.
Dryrot exists throughout the exterior wood members. Stairways to
front and back doors are in a dilapidated and dangerous condition.
Evidence of roof leaks occur throughout the building. Screens are
rusted thru contributing to the unsightly appearance. Porch ceiling
boards are loose and ready to fall off.
The interior of the building has been vandalized. The guard rail on
the front stairway has been destroyed. Wood trim has been removed
from the walls. Doors have been torn loose from their hinges. Many
windows are broken and the floor is warped.
The guard rails of the rear stairs from second to third floor has
been removed by vandals. The door frame at the bottom of the stairs
has been destroyed. Floor and floor covering materials are deteri-
orated. Plaster is deteriorated and has water damage.

The rooms on third floor have loose plaster and warped floors.
There is a 12 ' x 18 ' frame garage at the rear of the lot which
is also in a deteriorated condition. Roof sheething has dryrot.
Roof covering is old and in need of repair. Large doors have
loose boards and are in need of repair.
The property at 844 Dayton is zoned "B" residential which restricts
the occupancy of a building to a maximum of two apartments.
The Housing and Redevelopment Authority does not intend to acquire
this property.
The subject property has been boarded by the owner since July 15,
1972.
Inasmuch as the inadequate maintenance, physical damage and dila-
pidated conditions outlined above constitute a public hazard and
the owner has made no attempt to satisfactorily repair the damage
despite our warnings, and the continued vacant and boarded up con-
dition con�r.ibutes a blighting influence on the neighborhood, it
is the recommendation of this bureau that this matter be referred
to the City Attorney' s office for razing and removal through District
Court proceedings.
