The appellant is requesting a variance of Section 3304 (g) and (h) of the
Uniform Building Code which states that "walls and ceilings of corridors
serving an occupant load of 30 or more shall be of not less than one hour
fire-resistive construction."

L�:gislative Code to allow that eleven peo�ple sha.re four bathroaan facilities.

PROCEEDINGS
As a result of a Certificate of Occupancy inspectir��i, it w�.s ordered that
_ the appellant provide private bathroom facilities for each of nine units.
� Eleven people f"rom these niae units sha.re four bathroom Pacilities. All
other units in the building have private baths. Mrs. Haugen intends to or
has already cauplied with all other Certificate of Occupancy requirements.
The appellant is purchasing the building under a contract for deed. The
Building Department has no record of any complaints originating f5rom the
building. No children live in these units and Mrs. Haugen stated she would
never rent these units to a Pamily.
ACTION
Motion by Tieso to grant a waiver oP Section 54.11 of the St. Paul F,egis-
lativ�e Code until transfer of title to allaw that all non private bath units
shall be restricted to not more than an xcupancy of t�ro persons and that
total oecupaacy of all such units sha.11 not exceed eleven persons. Seconded
by Kamin.

PROCEEDINGS
Mr. Barghini presented letters of consent concerning the pro�ect from
t�no ad�acent neighbors. Mr. Ba,rghini stated that a third ad�acent
neighbor to the east gave verbal approval to the proposed construction
but did not xish to commit herself in writing. The wood and polyethylene
structure xill be removed within one years time.
ACTION
Motioc� by Tiesa to grant a temporary variance to Section 4.00-1c of the
St. Paul Legislat�.ve Code to enable the existence of a second detached
structure on a single lot. Such variance will be granted for a period
of 36� days commencing on such date as permit for construction is secured.
Upon expiration of such time,allowed proposed structure will be dismantled
and rer�oved. Seconded by Ka.min.

PROCEEDINGS
Mr. Segell stated thet the structure ha.s been used as a boarding home for
the past 15 years. Mr. Wozniak stated that the Board was concerned with the
saPety of the elderly tenants. Mr. Segell does not think the building is
going to be purchased by the Housing Authority in the neax fliture. Mrs.
Leonard stated tha:t none of the tena.nts are in need of a nursipg home. She
+�f feels that if they w�ere to mov�e, they vrould be lost. A survey of the
� prvperty by the Housing Bureau was ma,de on past req,uest by the Board.
Mr. Wozniak feels the main problem is the space heaters. There is no base-

_ _ ment in the structure xhich could house a f�rnace. Mr. Segell felt that
�►all heaters, as a substitute, �ould be unrealistic. If the building w�ere
,'•��-�' condemned, H�A ha,s a responsibility to relocate the tenants. Mrs.
Som�erdorf feels. ho�ever. that N'�.�,;, ��nard is prese: ��i� ; _ � _ - dous
coarm�znity service and ahould be moved as a unit and not relocatedcon a
separate basis. Mr. Segell muat determine whether the building can
f�asibly re repaired to code. Mr. Staffenson stated egress space is
limited due to location of space heater. Also, non-tc�NTED units can pro-
duce carbon monoxide. It wa,s sug�ested that if a fire occurred at the
space heater, a m�eans of egress f�om the upper floor would be total]_y
blocked. Proper space heaters must vent in exterior air for combustion
and vent out air after combustion. Mr, Tieso suggested that Mr. Segell
secure estima,tes to establish a cost figure to determine feasibility of
repair.

To be contiuued on November 22, 1972, at which time Mr. Segell will present
estimates concerning heating and electrical.
DISCUSSION
Mr. Wozniak related to the Board that he had met with Frank Staffenson,
4_ Glenn Ericicson and Ma,yor Cohen and that as a result of that meeting, more
clerical help ha.s been secured for the Housing Bureau in order to alleviate
the Bureau's clerical manpo�er shortage.
The Chairman also stated that when he �rent to observ�e 202 Sherburne, he was
surprised at the number of personnel who were inspecting the property, It
xas suggested that in many cases, one man could handle an inspection with
the availability of a technical backup if necessary. A deznand should be
made to the Mayor tha,t the Housing Bureau go to a one-man inspection system.
Mr. Wozniak atated that he saw a�re than five men inspecting this home.
It was resolved tha,t starting in the month of January, the Board will meet
in the Ramsey County Board room on Tuesdays at 1:30.

AMENDMENTS TO MINUTES OF MEETING ��'81
Amendments made upon request of Mr. Frank Staffenson of the City
Building Department are as follows:
The Building Department would like to go on record as having been
requested to perform a total survey of 202 Sherburne. In order
to perform a proper survey all men were needed.
Regarding American National Bank - The Building Department does not
believe that the Board of Appeals can vary a state law. The Build-
ing Department, however, has not received an opinion from the State
Department of Administration. While no legal opinion has been
handed down, Mr. Staffenson feels that the City Board of Appeals has
no jurisdiction concerning a state law.
