AN O�tDINANCE GRANTING PERh11SSI0N AND AUTHORITY TO INDEPENDENT SCHOOL DIS'fRICT N0. 625 TO CQNSTRUCT, MAINTAIN AND OPERATE A BUILDING ENCROACHING UPON TN'E FULL-WIDTH SEWER EASEMENT ON VACATED CARROLL AVENUE BETWEEN MOORE STREET AND PRIOR AVENUE. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That permission and authority are hereby granted to Independent School District No. 625 to construct, maintain and operate a building encroaching upon the full-width sewer easement on vacated Carrolt Avenue from a line 60 feet east of and parallel to the east right-of-way tine of Moore Street to a line 178 feet east of and parallel to the same said right-of-way line. Section 2. That the Director of Pubtic Works is hereby authorized to issue a permit to Independent School District No. 625 for the eonstruction of sald building encroach- ment, upon and subject to the following provisions, terms and conditions: a. That the permittee shall replace, at its own sole cost and expense, the existing storm and sanitary sewers to the satisfaction of the Public Works Department in accordance with plans and specifications on file with the Department of Public Works under City Project No. s-1532; b. That said permittee shatl give one week's advance written notification of the start of any construction to the Public Works Construction Engineer and shall aiso notify the Construction Engineer when construction is com- plete to allow for final inspectlon; c. That said permittee shall pay the cost of administration, engineering and inspection incur�ed by the Department of Public Works because of this under- taking; safd costs are estimated as a sum of Five-Thousand Dollars ($5,000.00) and shall be accounted for under Department of Public Works Project No. S-1532: e. Tha t said permittee shall construct the building on the easement at the :loca- tion specified in the plans and specifications. The approval of said building construction is contingent on the permittee acqui�ing the necessary building permits and meettng the requfrements specifled therein; f. That said permittee and/or its successors in interest shall , in the event the sewers must be repatred or replaced by the City at any time during which the proposed building or any part thereof remains in the easement, reimburse the City for any and all costs incurred in said sewer repair or replacement, due to the presence or removal of said building, which costs are in addttion to the costs related to the normal repair or replacement of said sewers; g. That said permittee and its succressors in interest expressly ag�ees and shail undertake to fully indemnify, hold harmless, and defend the City of St. Paul , its agents, officers and employees from any and all �amages, claims, losses, judgments, suits or expenses of whatever nature for injury to person and/o� property arising out of or connected with the construction, erection, mainte- nance, operation and removal of said buiiding; h. That said permittee shall , within thirty (30) days after passage of the ordi- nance, file written acceptance thereof with the City Clerk. Sect ion 3.
