WHEREAS, Minn. St. 15.50 authorizes the Mayor to appoint three
members of a body known as the Capitol Area Architectural and Planning
Commission subject to the consent of the Council, and
WHEREAS, the Mayor has discovered an error in appointments to
said Commission that has resulted in an unfilled position since
July l, 1973, now therefore be it
RESOLVED, that the Council �ereby takes the following action
to rectify the matter of appointments:r
1. Mr. Victor p. Reim, Jr. is acl�nowledged to be a duly
appointed and ratified member of the Commission with a four year
term to expire July l, 1975, and ,fu�ther that his appointment is
that of a successor to Mr. Robert4Goff.
2. A�irr. John Christensen is acknowledged to be .a duly appointed
and ratified member of the Commission fulf�].linq the four year term
of Mr. R. Richard Gauger which expires July 1, 1975; Mr. Gauger. being
the successor to Ms. Dorothy Masanz.
3. Acknowledges the Mayor' s declaration of a vacancy in the
member5hip since July l, 1973 due to the erroneous appointment of
i Mr. Robert Granovsky in that he was appointed to a four year term
commencing July 1, 19?1 when his predecessor Mr. Lawrence Rylander
was entitled to hold office until July l, 1973 and Mr. Rylander having
yielded his seat, Mr. Granovsky could only fulfill Mr. Rylander' s
unexpired term.

City Council
City of Saint Paul, Minnesota
Dear President Hunt and Council Members:
As the City Attorney has advised you by copy
of a letter to me dated May 13, 1974, certain errors in the
appointment of Saint Paul representatives to the Capitol
Area Architectural and Planning Commission have led to a
situation in which one of the present members is serving
illegally.
To rectify this situation, I have decided to
terminate the appointment of Mr. Robert Granovsky. To
fill the vacancy on the Commission which exists, I am
submitting for your review and approval the name of
Barbara Penn for a four-year term expiring July 1, 1977.

In the ma.tter of hazardous
buildings being that three story frame
eight unit apartment building and frame
garage in the City of Saint Paul known.
and described as 431 Ashland Avenue and
situated upon those premises legally
described as Lot 10, Block 12, Woodland
Park Addition to the City of St. Paul,
according to the plat on file and of
record in the office of the Register of
Deeds in and for the County of Ramsey,
State of Minnesota.
WHEREAS, pursuant to resolution, C. F. No. 262078, approved
September 7, 1973, a public hea.ring was scheduled for 10:00 a.m.
on September 20, 1973 before the Council of the City of Saint
Paul, said hearing pertaining to the condition of the structures
located at 431 Ashland Avenue, Saint Paul, Minnesota; and
WHEREAS, upon fa�ts pre�ented at said hearing consisting of
photographs, inspection reports and the recommendation of the
Division of Housing and Building Code Enforcement it is found and
determined by the City Council tha.t according to the records and
files in the office of the Register of Deeds, the last record owner
of the above described property is Keith J. Pederson and that
there are no lien holders of record; and that it is further deter-
mined that the above described buildings constitute hazardous
buildings within the definition of Minnesota Statutes Section

a. The building is standing vacant, abandoned
and is subject to being entered by unauthorized persons;
b. The exterior condition of the building is as
follows: The stucco is cracked and pieces are missing.
There are windows missing. The roof covering is deteriorated
and the cornice and gutters are rotted;
c. The interior condition of the building is as
follows: The basement is wet, steps are broken, floor
joists burned and the support columns are rotten. The
foundation walls are in poor condition, being cracked and
broken. The first floor is fire gutted, the ceiling and
floor are open and dangerous. Plaster is falling and
broken. The second floor and attic apartments have warped
floors, there is evidence of a leaking roof, the window casings
ha�te dry rot and the plaster is loose and falling. The
plumbing is taped and leaking and in poor condition. The
electrical system has been burned and is in very poor con-
dition. The heating plant is not serviceable. The pit in
which the boiler is located is full of water;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in its
present condition and the above correctionsl_uu�.st be made in
compliance with the Building Code and the Housing Code of the
City of Saint Paul in order to ma.ke the same habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical dama.ge, dilapidation and inadequate maintenance;
g. There is a double garage at the rear of the property
which is in a deteriorated condition;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463.15 through 463.26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby
make the following Order:
ORDER
1. The owner of the above described building shall ma.ke the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the ma.terials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order;
