Saint Paul, according to the plat thereof
on file and of record in the office of
the Register of Deeds in and for the County
of Ramsey, State of Minnesota.
qIHEREAS, pursuant to Resolution, C. F. No. 262977, approved
Janu�ry 24, 1974, a public hearing was duly held on Janua.ry 31,
1974 before the Co�uncil of th� City of Saint Paul, said hearing
pert�.ining to the condition of the structure located at 748
,_ Dayt�n__Avenue, Saisa.t Paul, Minnesota; and
TNHEREAS, upon the facts presented at the hearing consisting
of plhotographs, inspection reports and the recommendations of the
Divi�ion of Housing and Building Code Enforcement it is found �.nd
deteXmined by the City Council that according to the records and
f ile� in the office of the Register of Deeds, the last record
owners of the above described property are Matthew Zell, III and
United Realty Company of St. Paul (holder of an unrecorded interest) ;
and tha.t there are no lien holders of record; and that it is
furt�.er determined that the above described building is a hazardous
building within the definition of Minnesota Statutes Section 463.15
for the following reasons:

a. The building is standing vacant, abandoned
and is subject to being entered by unauthorized
persons;
b. The exterior condition of the building is
as follows: The two chimneys are deteriorated with
bricks loose and missing. The foundation is cracked
and falling. The sills and joists are decayed with
dry rot;
c. The interior condition of the building is
as follows: The first floor has suffered severe fire
damage. The second floor is completely gutted by
fire. All partitibns are burned and broken. Three
fourths of the roof has been burned, leaving the
interior open to the elements. The electrical, heating
and plumbing systems have been vandalized. The plumbing
has been removed. The electrical syster� has been dis-
con:nected and dama.ged by fire;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in its
present condition and the above corrections must be ma.de
in compliance with the Building Code and the Housing
Code of the City of Saint Paul in order to make the sa.me
habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
p�.ysical damage, dilapidation and inadequate ma.intenance;
now, therefore, be it
RESOLVED, that in accordance with Minnesota Statutes Sections
463.1� through 463. 26, and based upon the foregoing findings of
the C#�ty Council, the Council of the City of Saint Paul doe� hereby
ma.ke �he following Order:
ORDER
1 The owners of the above described building shall make the
same afe and not detrimental to the public peace, health, safety
and w lfare by having the said building razed and the materials
there rom removed from the premises within thirty (30) days from
the dste of the service of this Order;

2. Unless such., corrective action is taken to comply with
th-is Order or an answer served upon the �ity of Saint Paul and
filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Stunmary Enforcement of this
Order to raze and remove the said building will be ma.de to the
Ramsey County District Court;
3. In the event that the building is to be razed by the
City nf Saint Paul pursuant to judgment of the District Court,
all p�ersonal property or fixtures which ma.y unreasonably inter-
fere with the razin and removal of this building shall be
removed within ten �10) days from the entry of judgment; and if
not so removed, the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above deseribed real estate
and collected as other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners of the above described property in the manner provided
by law.

Honorable Council:
The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structure at the
location referred to above.
The owner of record is Capitol Contracts Inc.
The legal description of the property is Pt. of Lot 2, Block 6 ,
Nininger & Donnelly' s Addition.
The building is a 28 ' x 65 ' frame two story dwelling.
The two chimneys of this dwelling are deteriorated with bricks
loose and missing. The foundation is cracked and falling. The
sills and joists are decayed with dry rot.
The first floor has suffered severe fire damage. The second
floor is completely gutted by fire. All partitions are burned
and broken. Three fourths of the roof has been burned, leaving
the interior open to the elements .
The electrical, heating and plumbing systems have been vandalized.
The plumbing has been removed. Electrical sys`tem has been dis-
connected and damaged by fire.
This �building is too badly damaged by fire and decay to be feasible
to rellabilitate.
The H�using and Redevelopment Authority does not intend to acquire
this property.
The s�bject property has been boarded up by the city since December
11, 1973.

Inasmuch as the physical damage and dilapidated condition out-
lined above constitute a public hazard and the owner has made
no attempt to satisfactorily repair the damage despite our
warnings, and the continued vacant and boarded up condition
contributES a blighting influence on the neighborhood, it is
the recommendation of this bureau that this matter be referred
to the City Attorney's office for razing and removal through
District Court proceedings.
