WHEREAS� The Council of the City of Saint Paul vacated a
portion of McCa.11um Street adjacent to Lots 8 through 12� Block
7, Eaton and Morrison� s Addition to West Saint Paul, by Resolution
C. F. 93518 and as a condition of said vacation required the con-
veyance of portions of Lots 3 through 6, Block 6� Eaton and
Morrison' s Addition to West Saint Paul, for the extension of Ea.ton
Avenue, which conveyance was duly ma.de and accepted by the City of
Saint Paul as evidenced by the warranty deed filed in the office of
the Register of Deeds, Ramsey County, Minnesota� in Book 913,
Deeds, pa.ge 461, Document No. 841336, filed on October 21, 1932; and
WHEREAS� Eaton Avenue, from the Ea.sterly line of McCallum
Street to the Westerly line of Fenton Street, was duly vacated by
the City of Saint Paul upon petition of the Port Authority of the
City of Saint Paul pursua.nt to Resolution C. F. 228666, which vacation
of Eaton Avenue also released all public interest for street purposes
in those portions of Lots 3� 4, 5 and 6, Block 6, of Eaton and
Morrison' s Addition to West Saint Paul, which was conveyed and dedi-
cated to the City by the above-referenced warranty deed; and
WHEREAS� The Port Authority of the City of Saint Paul has re-
quested that the City now convey all of the City' s inter��ts in those
portions of Lots 3� 4� 5 and 6� Block 6, Eaton and Morrison' s
Addition to West Saint Paul� because this property is no longer
needed for the purposes for which it was originally conveyed to the
City of Saint Paul, being street purposes, and this property is now
pa.rt of the Riverview Industrial Park; now� therefore� be it
RESOLVED� That the Council of the City of Saint Paul does
hereby approve the request of the Port Authority, and the proper
City officers are hereby authorized and directed to execute quit
� claim deed on beha.lf of the City conveying and releasing all of the
interests of the City of Saint Paul to the following described
property:

Paul, the Northeasterly line of which is Fifty
(50) feet from and parallel to the following
described line:
Beginning at a point where the Southerly line
of Eaton Avenue intersects the Easterly line of
Eaton and Morrison� s Addition to West Saint Paul,
thence, Northwesterly to the Southwesterly corner
of Lot Four (4), Block Six (6) of said Eaton and
Morrison' s Addition to West Saint Paul, thence
Northwesterl to the Southeasterly corner of Lot

Dear Mr. Marzitelli:
The City Attorney, in attempting to replat the land con-
tained in Riverview Industrial Park, ha.d discovered tha.t
a portion of wha.t was formerly Eaton Avenue was dedicated
to the City of Saint Paul in 1932 by deed, which deed was �
delivered in compliance with City Council Resolution C. F.
93518, adopted September 12, 1932, vacating a portion of
McCallum Street. This portion of Eaton Avenue is now
vacated and I believe is no longer needed by the City of
Saint Paul for any purpose whatsoever. The property was
origina.11y acquired by the City for Eaton Avenue, and upon
vacating Eaton Avenue, the City Council is now in a posi-
tion to quit claim and release its interest to the Port
Authority. The land in question is a portion of Lots 3,
4, 5 and 6, Block 6, Eaton and Morrison' s Addition.
I have prepared and transmit herewith resolution for the
City Council approving the quitclaiming of the City' s
interest to the Port Authority, and request tha.t this be
submitted to the City Council for approval.
