WHEREAS, The City of St. Paul ha.s approved the plans and
specifications for the improvement of that art of T�k. Highw�.y �
No. 108 renumbered as Trun�c �iighway No. 61 �M�UNDS BOULEVARD)
within the corporate limits of the City of St. Paul from E. Seventh
St. to E. Third St. ; and
WHEREAS� In order to obtain Federal Aid in the construction
of said Trunk Highway No. 108 renumbered as Trunk Highway No. 61,
the Federal Highway Administration requires the assurance that the
City of St. Paul will not suffer any unlawful encroachment of any
na.ture or kind wha.tsoever on the right-of-way of said Trunk Highway
No. 108 renumbered as Trunk Highway No. 61 within the corporate
limits of the said City of St. Paul; and
WHEREAS� The Commissioner of Highways desires in the interest
of public safety tha.t all parking �tehicles on said trunk highway
be parallel with the curb and at least twenty (20) feet from any
crosswalk; now, therefore, be it
- RESOLVED, Tha.t said City of St. Paul does hereby agree and
covena.nt that it will never permit or suffer� within its corporate
limits, any unlawful encroachment of any kind wha.tsoever, including
curb gas pumps and gas stations, billboards or other structures of
any kind whatsoever� upon the right-of-way of Trunk Highway No.
108 renumbered as Trunk Highway No. 61 and, to the above end� said
City of St. Paul hereby agrees that it will never issue any license,
permit, or grant, or give any leave or liberty or any other consent
of wha.tever form for the construction or ma.intenance of any unlawful
encroachment whatsoever, including curb gas pumps and gas stations,
billboards, or other structures of any kind wha.tsoever� upon said
right-of-way; and tha.t said City of St. Paul will cooperate inso-
far as possible to elimina.te existing encroachments constituting
traffic hazards and will further take any necessary action to
elimina.te any encroachment tha.t ma.y hereafter exist on said trunk

Attached for your approval and subrnittal to the City Council are
resoiutions authorizing approval of cons�truction plans and special pro-
' visions for fhe improv�ment of Mounds Blvd. between Third St. and Seventh -
St. Th�� construction will aiso include construction of a storm sewer to
collect drainage from adjacent streets east of t4ounds Blvd., as wzll as
n���r cannections for the existing sanitary sewars, City Project S-1527.
This work will be accomplished by cooperative construction agreement bet-
wcen the City and the Highway Department. �
Preliminary plans were first approved on December i6, 1971 , Council
Fiie #�25b768 and subsequently approved on October 24, 1g73: Councii File
#r26241$ after design modifications were made to save several tre�; ir► front
of the Granville House at 334 Mounds Bivd.
The Highway Department will open bids for this work on April 2b, I974
which will provida one full co�struction season to accamplish �nough work
items to have this roadway opzn to traffic by late fall of 1974.
