Comes now your Petitioner and respectfully represents and shows
to the Commission the following:
1. Tha.t the City of Saint Paul is a municipal corporation in
the County of Ramsey and State of Minnesota and is operating under
a home rule Cha.rter pursua.nt to authority granted by the Constitution
of the State of Minnesota.
2. The Council of the City of Saint Paul, by resolution (capy �
attached) adopted by a ma.jority vote of its members, has directed
the City Attorney and the City of Saint Paul ma.ke written Petition
for the relief contained herein to the Minnesota Department of
Public Service.
3. That the Chicago, Milwaukee, St. Paul and Pacific Railroad
Company is a common carrier by rail subject to the jurisdiction of
the Minnesota Department of Public Service.

4. Tha.t the said Ra.ilroad company operates and maintains
tracks within the City of Saint Paul, which tracks form railroad
crossings with street, roads and highways; and specifically there
exists within the City of Saint Paul a railroad crossing with
Minnesota State Trunk Highway No. S (West Seventh Street) and
Alton Street. �
5. Tha.t pursua.nt to Petition of the City of Sain� Paul, this
Commission, by its decision and order dated May 5, 1969, as modi-
fied by additiona.l decision and order dated Ma.y 4, 1970 (copy of
which orders are attached), the Petition of Chicago, Milwaukee,
St. Paul and Pacific Railroad Compa.ny for authority to abandon and
remove the highway railroad grade crossing located at the point
where Alton Street crosses its Ford line spur track in the City of
Saint Paul was granted, and the City of Saint Paul was ordered to
close this opening to vehicular traffic.
6. The City of Saint Paul hereby requests that the Public
Service Commission modify its previous order so as to permit the
ma.intenance of the highway-railroad grade crossing located at
Alton Street described above because Alton Street has transportation
- -- • significance since it connects Trunk Highway No. 5 (West Seventh
Street) with Shepard Road.
WHEREFORE, PETITIONER PRAYS, Tha.t this Honorable Commission
proceed to investigate the advisability of permitting the continued
existence of the highway grade crossing located at a point where
Alton Street crosses the Chicago, Milwaukee, St. Paul and Pacific

track and Davern Avenue and Edgecumbe Road at grade U�ith four tracks.

That the trai.n traffic over�this line of railroad a.nd the four crossings
herein under consideration consists of three freight trains in each direction
daily, Manday through 'r�iday of each s��eek, �,*ith an occasional extra train
each direction as business of the �'ord Plant requires, In addition to the
regular t�.ain movements over the crossings there are occasional s�ritch moves
made over the Alton Street and L1est Seventn Street crossings, and several
si�itch moves made over the Davern Avenue and Edgectunbe Road crossings daily.

That the speed of the moving trains over the four crossings varies from :
a slow cra�Jling speed to about five m�1es per hour. The Davern Avenue and
Edgecumbe Road crossings are blocked several times a day by standing trains

CONCLUSIOATS . � �
The Comr2ission has consolidated the hea:ings held on the four crossings
herein under consi�.eration and is issuing one order to cover the four applica-
� tions and crossings as its inves-�igation discloses that the controls� of �
� whatever protective devices axe ordered installed at the `J7est Seventh Street
� crossi.ng �rill be affected by the disposit�on of the peti�ions pertaining to
the Alton Street and the Davern Avenue crossings. The Coiranission finds
� further tha t in�order �o increase the speed of �rains over the �:'est Seventh . �
Street crossin� that the crossing at Davern Avenue t�rill have to be espeeially
protected V�ith automatic signals or closed to vehicular traffic. . •
It appears that� except for traffic that has its ori�in or destixiation� in�

fifteen (15) mi.les per hour, unless circumstances and conditions prevent the

It appears that the closing of the Davern Avenue Crossing will cause
undue inconvenience to the trav�eling public usi.ng the crossing and it�
therefore, should remain open for vehicular and pedestrian traffic.
III
That to �m ovids adequate protection for t�he general public using the
crossing and to permit train speeds of up to 15 mil.es per hour over the
crossing it will be necessary to install Minnesota Standard Automatic
Electric Highway Railroad Grade Crossing Signals at the Datrern Avenue
crossing.

crossing located at the point where Davern Avenue crosses its Ford Line Track

That the Chicago, Milwaukee, St, Paul. and Pacific Ra.ilroad Company shall�
within one year of the da.te of this order, instaZl T�iinnesota St,andard Automatic �
Electric Highti�ay Railroad Grade Crossing Signals in accordance with plans to be
approv�ed by this Commission, at the crossi.ng of Da.vern Avenue and its Ford
Line Irack in the City of St. Paul� Mi,nnesota.

curb line in the Northwest qua.drant of the Davern Avenue crossing to fit the
signal installed in that quadrant, which will be installed to protect an
effectiv�e two 1.ane crossing.
