Saint Paul Legislative Code, pertaining

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the 5aint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "B" Residence District to "C" Residence

District, to-wit:

Lots 2, 3, and 4, except the North 100
feet, Zimmerman Place, and east 96.15

Dear Madam:
This is written in response to the petition of St. John's Lutheran Hospital
to rezone, from "B" Residence to "C" Residence, property located on the south
side of East Seventh between Maria and Bates, and their application for a
permit to install 247-car parking lot on the same property. This property is
further described as follows:
Lots 7 through 11, Reed's Place, and Lots 2, 3, and 4, except the
North 100 feet, Zimmerman Place, and east 96.15 feet of Lot 2,
Auditor's Subdivision No. 19.
The rezoning was heard by the Board of Zoning on January 24, 1974, at which
time staff said the requested zoning would be appropriate under the proposed
zoning code. Staff said there was one additional parcel of property which should
be included in the description of the parcel to be rezoned, as it would be
spot "B" Residential surrounded by "C" Residential and Comnnercial property if it
were not rezoned. Staff reco�rtnended approval of the rezoning.
The attorney for the petitioner and neighbors discussed the need for the parking
and the plans for purchasing additional properties on that block.
A motion to recoumiend approval of the rezoning carried unanimously.
The application for their parking lot permit was heard by the Board of Zoning
on February 21, 1974. At that time staff explained the use of the parking lot
and that one of their parking lots across East Seventh Street would be phased out
and combined with this facility. Staff recotmmended approval of the permit.
After discussion, a motion to recommend approval of the permit carried unanimously.
Revised plans received March 4, 1974, meet design standards.

A. SUFFICIENCY: In a letter dated December 11, 1973, the Director, Department of
Finance and Management Services, declared the petition sufficient with the owners
of 39 out of 57 eligible property owners having signed the petition.

B. HISTORY: In 1948 a permit was issued for a parking lot for St. Paul Terminal
Warehouse on Lots 7 through 11, Reed's Place. An application for a permit for
a 247-car parking lot was submitted in 1973 but was held in abeyance pending
' this zoning action.
C. PROPOSED USE: The petitioner declares the use to be a parking facility serving
St. John's Hosp�ital,
D. FRONTAGE AND AREA: The site has a frontage of 220 feet on Sixth and a depth of
approximately 357.47 feet. There is about 75 feet of frontage on Bates.
The site has an area of 76,532.44 square feet. ;

E. COMPREHENSIVE PLAN: The Comprehensive Plan recommended Semi-Public for the �
northern portion and one, two, three, and four family residences, town or �
row houses and walk up apartment structures, maximum density - 25 dwelling units ''
per net acre for most of the southern portion. I

F. AREA ZONING: Frontages along East Seventh and Maria are C�ercial. The area �
east of Maria is "B" Residential and west is predominantly "C" Residential. �
G. SITE CONDITIONS: The site is vacant.
H. AREA CONDITIONS: East Seventh Street is developed with mixed Co�nercial and �
Residential uses. The rest of the area is mostly R�sidential. �

Floyd E. Nelson, being first duly sworn, says:
He is the assistant administrator of St. John's
Hospital. He personally secured all of the siqnatures that
appear on the attached Petition for Rezoning.
In many instances the persons who signed reported
that the real owners of the various descriptions were different
from the record ownership as reported by St. PauZ Abstract &
Title Guarantee Company. In this Affidavit affiant sets forth
information given to him relative to real ownership. References
are made to the page and description number appearing on the
Petition.
Paqe 1, Description No. 8. The abstract company's cer-
tificate lists Antoinette and LaFay Carbone as owners of one-half
and Frank and Agnes Carbone as owners of one-half. Antoinette
and LaFay have not signed the petition. In their place Mario ar�d
Dorothy Carbone have signed. Those who signed informed affiant
that Antoinette and LaFay sold their interest to Mario and Dorothy.
Frank and Mario are brothers. Antoinette is their mother and LaFay
is their sister.
Paqe 2, Description No. 15. The abstract company's cer-
tificate lists John Klune as tY�.e record owner. He is a realtor
and is selling the property on contract for deed to Ronal.d M. and
Janet S. Pierre. The contract purchasers have . signed the Peti-

Cicale is deceased and Lucia Cicale is too old to sign. The three
