Dear Mayor Cohen :
It is anticipated that the City of St. Paul , through the Department
of Public Works, will be entering into an agreement with the State of
Minnesota, Department of Nighways, for the State's construction of the
referenced City Project which will include installation of a storm
sewer on Wagener St. from Mounds Blvd. to an in-place storm sewer. To
facilitate this construction, the State has requested a temporary con-
struction easement across certain tax forfeited lands that were recently
conveyed to the City by the State of Minnesota for the Swede Hollow Park
Program.
I have, therefore, attached for your approval for submission to the City
Council a proposed resolution, approved as to form, authorizing the
proper City officers to execute a grant of slope permit.
After the passage and approval of the resolution and the subsequent
execution of the permit, it will be forwarded immediately to the. Ramsey
County Land Commissioner's Office for execution by the proper County
officers.
Please consider this matter as expeditiously as possible.

Grantor, of Ramsey Couaty, Minnesota, for the good and valua.ble consideration hereinafter
contained hereby grants to the State of Minnesota for a period of time terminating
December 1, 1.976, the right to construct a slope or embankment slope and stockpile
adjacent to and as a part of the general plan of improvement and protection of Trunk
Highw�y No. 61 and 94 on the following described real estate in the County of Ramsey,
in the State of Minnesota� all that part of the following described tract:
Lots 1 through 7, Block 2 Wageners Addn. to St. Paul and that part
of SE 34 of NW ya of Sec. 32 T29NR22W lying' sl;� of Wagener St. & Ely
of a line run from a point on Sly line of Wagener St. & 40 Ft. Ely
from original N P $y 8JW TH sly 141 Ft. Mol to point on S line of
SD NW }� 63 ft. Ely from SD R/W as shown colored in red on the print
attached hereto and made a part thereof.
R�e State shall have the right to remove all trees, shrubs, grass aad herbage within the
construction area.
It is agreed, and the right is hereby granted, tha.t all earth or other material
necessarily excavated, removed or taken from said premises in the construction of said
slope shall become the property of said State to be re�ved, or used in the construction
of Trunk Highw�y No. 61 & 94 or otherwise disposes of as the State c�y deem fit. The
State will, for the protection of said slopes, sod or seed same.
The Grantor, his heirs, executors and assigns, hereby releases said 5tate, its officers
and agents, from any and aIl iiability and claims therefore concerning said premises
and the grantor's adjoining premises, that result or m�y result therefrom by �rirtue
of the construction of sa.id slope and all work on connection therewith.
