WHEREAS� the City of Saint Paul and Timothy
Christian are party defendants in the ma.tter of
Joseph A. Doyle, a minor, by Thoma.s D. Doyle, his
father and natural gua.rdian, and Thomas D. Doyle,
persona.11y, vs. Timothy Christian, Highland Park Pool,
and the City of Saint Paul,
WHEREAS� the incident tha.t is the subject ma.tter
of plaintiffs' claims occurred at the Highland Park
Pool and arose out of the act of Timothy Christian,
an employee of the City of Saint Paul, during the
performance of his duty as ma.nager of the pool,
RESOLVED, tha.t the City Attorney be and hereby
is directed to defend said Timothy Christian against
any and all claims brought by plaintiffs in the above
matter.

SUBJECT: Action by Joseph A. Doyle and Thomas D. Doyle
against City of St. Paul and Timothy Christian
Enclosed is a Resolution directing the City Attorney
to defend Timothy Christian, the manager of the Highland
Park Pool, in the above matter. The action arose
out of an incident on July 19, 1973, when Joseph A.
Doyle was allegedly injured by the acts of Timothy
Christian who was performing his duty as manager.
There is no additional expense to the City to assume
the defense, since the City is already a party d.efendant
to the action.
Under Minn. Stat. Section 466.09 it is discretionary
on the part of the governing body of the City to defend
any of its employees against any tort claim arising
out of an alleged act occurring in the performance of
duty.
