Dear Sir:
This is written in response to the appeal of Gordon Marschinke to allow a
Fast Food Restaurant access to a res�dential street, and an application for
a permit for drive-in remodeling, on property located on the northwest corner
of White Bear and Californis.
This matter was heard by �the Board of Zoning on January 24, 1974, at which time
staff recommended approval.
The representative of the appellant said this matter was approved by the Board
of Zoning at a meeting on September 20, 1973.
The appellant said the median on White Bear Avenue was put in after he purchased
this property and has effectively cut off all left turns into his property.
When the matter was heard by the City Council he was not present at the meeting
to present the facts and thought this was the reason it was denied. He said he
would explore the use of a mechanical arm in the driveway on California.
Neighbors appearing in opposition stated that when the driveway first came in
they where assured there would never be a entrance or exit into the residential
area. They sa�d California is a narrow street and is not able to bear the
additional traffic.
A motion was made to recommend approval of the appeal and permit a nd carried
by a vote of 4 to 1. During the vote it was stated that they didn't think
denying it would help the problem of traffic on the residential street.
Plans received May 16, 1973, meet design standards.

Gentlemen:
Please be advised that the undersigned represents Gordon Marschinke,
the owner of Jerry's Drive-Tn, located at 1661 White Bear Avenue,
Saint Paul, Minnesota, for an Appeal to allow his Restaurant access
to a residential street. The subject property is on the Northwest
corner of White Bear and California, and is legally described as
follows, to-wit:
The East 205 feet of the South 133.25 feet of the North
266.5 feet of Lot 1, Kerwin's Outlots.
I am attaching herewith a Report of the Board of Zoning, which explains
the action of the said Board of Zo�ning on September 20, 1973 , which
recommended approval unanimously to allow the said Petitioner to
remodel his Drive-Tn, and to allow the variance to maintain a driveway
on California Street.
The particular Zoning Code Chapter is 60 .05f as amended 1973.
The history of the matter is adequ'ately explained on the attached
copy of the Board of Zoning Re�ort and Action dated September 20, 1973.
The Council Hearing was held on October 18, 1973, and the Petitioner
at that time misread the Notice of Hearing thinking that the Hearing
was at 2 :00 in the afternoon, and not at 10:00 in the morning, and
missed the Hearing. Because of the fact that he did not appear at
the Hearing before the City Counci,l, the matter was denied by the
Council, but not on its merits.
We are therefore appealing the said Council Action, and respectfully
request that the mat�er be placed back on for hearing as promptly

A. HISTORY: This same appeal was requested in 1973, at which time the Zoning Board
recommended approval, The City Council denied the appeal. The petitioner was
not present at the hearing bef_ore the Council. A permit to install a drive-in
was granted in 1950. In 1963, addi�tional property was rezoned to Commercial
and a permit granted to allow expansion of the drive-in westward. In 1964, a
permit to remodel was granted.
$. PROPOSAL: The appellant wants to maintain a driveway to a street used primarily
for access to abutting residential property, a situation prohibited by the fast
food restaurant standard of the zoning code. (reference: section 60.05f as
� amended 1973)
The City Attorney has advised staff that the parking lot does not have to conform '
to the new drive-in standards if the lot is not being substantially changed. The
. drive is existing but has not been authorized by a special use permit. The
resolution granting the drive-in permit in 1963 specifically prohibited any drive
onto California. The Traffic Engineer, in 1970, ordered that the drive be
closed. -
C. AREA ZONING: A large Commercial district with irregular depth fronts White
Bear Avenue. Small "C" Residential districts adjoin this district west of White
Bear on Iowa and Montana Avenues. The area on either side of the Gommercial
frontage is zoned "A" Residential.
D. FRONTAGE AND AREA: The irregular site has a frontage of 100.35 feet along
White Bear Avenue and 113.SO feet along California Avenue, for an area of
24,296.75 square feet.
E. 3iTE CONDITIONS: The site is developed with a drive-in much as is proposed
. except that the proposed alteration would add to the east side of the building.
F. AREA CONDITIONS: White Bear Avenue frontage is developed with Commercial uses,
mostly retail. Residential use adjoins the site and continues westward.
