WHEREAS, the City of Saint Paul has issued to Serpent, Inc.
at 1 South Wabasha Street in the City of Saint Paul, the following
licenses; On-Sale Intoxicating Liquor License No. 8563; On-Sale
Non-Intoxicating Ma.lt Beverage License No. 1216; Off-Sale
Non-Intoxicating Malt Beverage License No. 1216; Tavern License
No. 1216; Class C-1 Restaurant License No. 1216; and Cigarette
Vending Ma.chine License No. 1216; and
WHEREAS, a public hearing was held before the Saint Paul
City Council sitting as a committee of the whole on March 15, 1974
and March 22, 1974 pursuant to a Notice of Revocation or Suspension
Hearing sent to the Serpent, Inc. on February 25, 1974, a copy of
which is a ma.tter of record at the hearing; and
WHEREAS, at such hearing evidence was presented by the City
of Saint Paul i�. support of its reconunendation that the 'license
be revoked or, in the alternative� suspended and also evidence
presented by the licensees in opposition to such recommendation
of suspension or revocation; and .

WHEREAS, following such hearing the Saint Paul City Council
sitting as a committee of the whole recommends to the City Council
of the City of Saint Paul that the above specified licenses issued
to �he_.�erp.�.�, Inc. at 1 South Wabasha be suspended for a period
of ���y_ {�p) days f or the time period to be specif ied by the
Saint Pau1 City Council; now, therefore, be it

RE: Recommendation of Suspension of Licenses Issued
to the Serpent, Inc.
On Ma.rch 15, 1974, and Ma.rch 22, 1974, a hearing was held before
the Committee of the Whole of the �aint Paul City Council pur-
suant to a Notice of Revocation or Suspension Hearing submitted
to the Serpent, Inc. on February 25, 1974. At such hearing
evidence was presented by the City of Saint Paul through testimony
of lay witnesses and police ':officers of the C�.ty of Saint Paul
relative to certain� conduct ori the premises� of the Serpent, Inc.
at 1 South Wabasha in the City, of Saint ,Paul between November of
1973 and March 1, � 1974. . Evidence was aiso presented by the
licensees relative to the allegations ma.de by the City of Saint
Paul.
Based upon the following findings, the Committee of the Whole of
the Saint Paul City Council recoc�nnends that the licenses issued
to the Serpent, Inc. at 1 South Wabasha Street in the City of $aint
Paul be suspended for a period of thirty (30) days with such period
of time to be set by the City Council at a regular meeting of the
Saint Paul City Council:
l. Disorderly conduct in the nature of fights was found to have
existed on the premises on November 23, 1973, December 8, 1973,
December 29, 1973 and February �, I974, which evidenced a
failure on the part of the lice�see to maintain order in the
licensed establishment. '
2. It is found that an employee of the licensee refused to
return certain propetty to a patroih. after the employee had
obtained possession of that pro erty without the consent
of the patron on November 25, '1�73. Since a licensee is
responsible for the conduct of its place of business, this

evidences a failure on the part of the licensee to
conduct his place of business in, an orderly fashion.
3. Following the assault whic�i. occurred on the licensed
premises on December 8, 1973, and th� fights which
occurred on the prQemis�s on February, 2, 1974, the
licensees failed to pr`omptly cooperate wit'h the Police
Department in the investigatipn ,of these critc�ina.1
offenses. ,
4. The evidence presented establishes that the licensee
by action of its officers or its employees is guilty
of misconduct in the operation of its business in that
such conduct was detrimental to the public good of the
City of Saint Paul.

TO: THE CITY COUNCIL OF SAINT PAUL
As legal counsel for Serpent, Inc. , we respectfully submit
for the Council' s consideration the following alternatives to the
license suspension of thirty days embodied in the Licensing Committ�e
Resolution of March 22, 1974 :
A. A reprimand without suspension because the problems
giving rise to the hearing have been entirely solved.
B. A suspension of a much less extreme severity, such as
ten days, running from P�iarch 22nd, the date of the Resolution, news
report� of which substantially damaged business beginning that day.
C. A suspension of reasonable length to apply each
Sunday through Thursday, allowing the business to operate on Fridays
and Saturdays only during that period.
D. A reasonable suspension of the liquor license, but
allowing the business to serve beer only during the period of
suspension.
E. Any other measure which the Council deems appropriate
but less extreme than the thirty day suspension of the entire
operation of the business.
