Bernstein, Lessor, and City of Saint Paul, Minnesota, a municipal corporation, Lessee, dated 3anuary 1, 1974. HEAT AND WATER ' Without additional charge, and as part of the rental, the Lessor will provide heat for the premises and water. The failure to furnish such heat and water, if not occasioned by the willful failure on the part of the Lessor, shall in no way render the Lessor liable to Lessee or others. If Lessor fails to repair within a reasonable time, after some defect arises, the lessee may terminate this Lease without notice. Tenant agrees not to waste any of the water. � In the event the premises become untenantable, because of fire, or other casualty loss or condemnation, the Lessee may terminate this Lease without notice. WAIVER OF SUBROGATION It is agreed and understood that tenant shall not be liable to Lessor, noi shall Lessor be liable to tenant, for any loss or damage resulting from any insurable hazard to the leased premises, or to the building of which the leased premises are a part, or to the �ixtures and contents located therein covered by policies of insurance of the Lessor or tenant. This provision shall apply especially, but not exclusively to damage caused by water, snow, rain, hail, backing up of water mains, or sewers, frost, steam, sewage, illuminating gas, sewer gas, or odors, electricity and electric current, and bq the bursting, stoppage or leaking of pipes or radiators, plumbing, sinks, and fixtures in or about the demised premises.
