Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the appeal of Central Baptist Church to relax setback requirements on property located on the southeast corner of Roy and Shields. This property is further described as follows: Lots 25 through 30, Block 1, Milham Park Addition. This matter was first heard by the Board of Zoning on November 1, 1973. Staff reported that the appellant wishes to: rearrange the use areas of the present church buildings and cons.truct an addition which would be within 4 feet of the property line along Roy Street. The present setback requirement along Roy Street is 12.7 feet. After the Board discussed the appeal with the staff, Pastor and architect for the church, and neighbors, the matter was laid o��er for further study. The matter was again heard by the Board on November 15, 1973. The staff reported that new plans were drawn which showed no building within 14 feet of the south property line and no addition to the front of the existing worship center. The staff recommended approval. The Board of Zoning voted 4 to 0, with one member abstaining, to recommend approval of the appeal to relax the setback requirement to 4 feet provided that the most southerly 14 feet of the lot be unobstructed by any building. HISTORY: A setback variance from 12.�' to 4' was granted in 1961 for the north 15' of Lot 28, and all of Lots 29 and 30 in Block 1, Milham Park Addn. , but the construction proposed for the site at that time was never undertaken. B. AREA ZONING: The areas to the north and east of the site which border University Avenue and Snelling Avenue are zoned Light Industrial. To the south and west of the site, the area is zoned "C" Residential. The site itself is zoned for "C" Residence. C. PROPOSAL: The applicant wishes to relax the setback requirement in order to add to the existing church building on the site. D. VARIANCE: The proposed addition would be in violation of the required setback in that it would be 4 feet instead of the required 12.7 feet. This is approximately 69.5% short of the requirements. E. SITE CONDITIONS: The existing church is constructed on a part of the site raised about four feet above street level. Two older frame houses occupy a portion of the site. This portion of the site is also raised about 2 to 3 feet above street grade. The remaining part of the site is at street grade and vacant. F. AREA CONDITIONS: The neighborhood is composed of older single and two family homes, as well as several multiple-family units along Pierce, Shields and I-94. 9.
