WHEREAS, on November 27, 2002, in Council File No. 02-1116, the Council of the
City of Saint Paul duly adopted a resolution approving a moratorium of limited duration for the
puipose of studying ]and uses in the Sunray azea; and

WF�',REAS, the Council desires now to amend Council File No. 02-ll 16 to the extent
6 necessary to enable the developers of a proposed Krispy Kreme restaurant to move forward with
7 their various zoning and building applications which would otherwise be prohibited under the
8 terms and conditions set forth in Council File No. 02-ll 16 and in an accompanying interim
9 ordinance presently under considerarion in Council File No. 02-ll 15; and

WHEREAS, a commercial use of the type proposed by the Krispy Kreme developers is a
desirable land use within the present and future context of land uses in the Sunray Area; NOW,
THEREFORE, BE TT RESOLVED, that Council File No. 02-1 ll6 shall be immediately
amended so that its provisions shall not prevent the Krispy Kreme developers from applying for
and, if approved, receiving any zoning or building pernuts necessary to undertake the
construction of their proposed development; AND,
BE IT FCTRTHER RESOLVED, that Council File No. 02-1115, shall also be amended
to permit the Krispy Kreme developers to apply for and, if approved, receiving any zoning or
building permits necessary to undertake the construction of their proposed development.
