MEMORANDUM
T0: COUNCIL
RE: Registered Bill No. 3-7025
This bill is the result of an accident between a City
police vehicle and a car owned by Minnesota Milk and
driven by one of their employees. The police vehicle
was on an emergency run and entered the intersection
of Dale and Concordia against the red signal . Both
vehicles had their vision of the intersection obstructed,
resulting in the collision. This is failure to yield
the right of way situation and a settlement of 80% of
the City' s claim is the normal recovery if the claim was
pressed to litigation. Based upon the above , this office
recommends settlement of the City's claim of $878 .41 at
$701. 13 ,
