WHERF�AS, the Council of the City of Sa.int Pa.ul on May 27, 1973,
approved Final Order C. F. 261353, whieh authorized the acquisition of
highway ea.sements to open, widen and extend Transfer Roa.d from University
Avenue to Prior Avern�.e; and
Wherea.s, the Department of Finance and A�.nagement Services, through
its Valuation Erigineer, recommends the City acquire the needed right-of-
way from the present awner, Burlington Northern, Inc. , for the sum of
$39,�•�, the right-of-way being more flilly described belaw, which sum
of $39,�+�+0.00 is a fair and reasonable consideration for the interest to
be acquired by the City; naw, therefore, be it
RESOLVED, tha.t the Council of the City of Saint Pa.ul does hereby approve
and authorize the acquisition of the following tract for street purposes
for the sum of $39,4�+0.00, to be pa.id f"rom PIR Fund 60000-7�+5-000, to be
reimbursed from 1q74 MSA Funds, and the proper City officers are authorized
to execute the necessary documents for purcha.se of' the land described as
follows:
An easement for street and highway purposes on, over and across
a tract of land lying and being in the Southwest ,�—� of Section 28,
� Township 29 North, Range 23 West, described as follows:
A strip of land 100 feet wide in the NW,�—� of the SW,�—�
of Sec 28 T.2gN R.23W. extending from the W'ly
bounda.ry of Prior Avenue, W'ly to the S'ly production
of the W'ly line of Block l, Lovering Factory and
Warehouse and Transfer Property;
Also, all of Lot 9, Block l, Lovering's Fa.ctory and
Warehouse Property together with the right of access
bein� the right of Ingress to and egress from the westerly
130.�+ feet o� Lot 8 of said Block 1 to Transfer Road.
