WHEREAS, pursuant to resolution� C. F. No. 263203� approved Ma.rch 12, 1974, a public hearing was scheduled for 10:00 a.m. on Maxch 21� 1974, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 528�530 Ashland Avernte, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and the recommendation of the Division of Housing and Building Code Enforcement, it is found and determined by the City Council tha.t according to the records, and files in the office of the Register of Deeds, the last record owners and parties of interest in this property are W. S. Orenstein, fee owner� and Ra.y M. Wellens� contract purchaser; and that it is further determined that the above described building constitutes a hazardous building within the meaning of Minnesota Statutes Section 463.15 for the following reasons: a. The exterior condition of the building is as follows: The rear porches are deteriorated to such an extent that they could be dangerous. The roof has burned and could collapse. The interior rear stairway has been burned out. The foundation walls are cracked; c. The interior condition of the building is as follows: The interior of the building has been vandalized. The first floor is water soaked from fire fighting and the elements. The second floor is badly burned and gutted across the rear of the building. The third floor has heav�3� fire damage and the roof is burned through. The plumbing, electrical and heating systems have been vandalized. The plumbing fixtures are broken a.nd missing. The electrical system is burned and there is open wiring throughout the building. The gas-fired boile� �nd radiation ha.ve been vandalized. Because of the damage from fire and vandalism, this �iuilding is beyond rehabilitation; d. The building in the above condition is beyond reasonable repair; e. The building is unf it for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; � f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation and inadequate ma.intenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Section 463.15 through 463.26, and based upon the fore�oing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER l. Unless such corrective action is taken �o comply with this Order or an answer served upon the City of Saint Paul and tiled in the Office of the Clerk of District Court of Ramsey County, Minnesota within twenty (20) days from the date of the servic.e of this Order, a Motion for Su.mma.ry Enforcement of this Order to raze and remove the said building will be ma.de to the Ramsey County District Court; 3. In the event tha.t the building is to be razed by the City of Saint Paul pursua.nt to judgment of the District Court, all personal property or fixtures which ma.y.unreasona.bly inter- fere with the razing and removal of this building shall he removed within ten (10) days from the entry of judgment; and if not �o removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real eState and collected as other taxes; and be it FURTHER RESOLVED, That a certified copy of this resolution and incorporated Order herein be served upon the last record owner of the above described property in the manner provided by law. Re: 528 Ashland 3-19-74 The subject property has been boarded by the city since December 10, 1973. Inasmuch as the physical damage and dilapidated conditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, it is the recommendation of this bureau that this matter be referred to the City Attorney' s office for razing and removal through District Court proceedings.
