WHEREAS,,,pursuant to resolution, C. F. 261616, approved July 10 1973, a public hearing was scheduled for 10:00 a.m. on July 26, 19�13 before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structures located at 491 Ashland Avenue, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and the recommendation of the Division of Housing and Building Code Enforcement, it is fovx�.d and determined by the City Council tha.t according to the records and files in the office of the Register of Deeds, the last record owner - of the above described property is Gerald Bensfield; and that there are no lien holders of record; and that it is further determined that the above described buildings constitute hazardous buildings within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. P:�is't 4, b. The exterior condition of the building is as follows: The front porch and the front and side entry steps are deteriorated. The limestone foundation is bowed and open; c. The interior condition of the building is as follows: The beam in the basement is sagging and the posts have deteriorated and have settled. Windows are broken and deteriorated. The interior floors slope and are deteriorated. The plaster is broken and missing and is water stained indicating that the roof leaks. Most of the windows are broken and the window panes are deteriorated. The plumbing and electrical fixtures have been vandalized. The building has deteriorated se�erely and it would appear to be infeasible to rehabilitate; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for human habitation in its present condit�.on and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate maintenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections . 463.15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER l. The owner of the above described buildings shall ma.ke the same safe and not detrimental to the public peace, health, safety and welfare by having the said buildings razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. In the event that the buildings are to be ra�ed by the City of Saint Paul pursuant to judgment of the District Court� all persona.l property or fixtures which may unreasonably interfere with the razing and removal of these buildings shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such persona.l property and fixtures as provided by law; 4. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above described real estate and collected as other taxes; and be it FURTHER RESOLVED, that a certified copy of this resolution and incorporated Order herein be served upon the last record owner of the above described property ini�.e manner provided by law.
