WHEREAS, the City of Saint is undertaking a study of the Sunray Area which will result
in the adoption of a small azea plan summary for the Sunray Area into the City's comprehensive
plan; and
WHEREAS, the said study may lead to the adoption of amendments to the City's
comprehensive municipal plan and to its official zoning controls within the Sunray Area; and
WFIEREAS, development within the Sunray Area during the study could result in land
uses which would not be consistent with the on-going goals and requirements of the 19991and
use plan or comprehensive plan; and
WHEREAS, the potential for incompatible or inconsistent development within the
Sunray Study Area raises substantial questions relating to the ability of the City's present official
controls to provide compliance with the comprehensive plan; and
WHEREAS, in light of the pending Sunray Area study, for the purpose of identifying an
overall vision for this pivotal area and for the immediate need to preserve the status quo with
respect to land use and to protect the general health, welfare and safety of the public pending the
conclusion of the said study, the Council of the City of Saint Paul desires to immediately
temporarily prohibit development on any parcel of land or part thereof within the areas of the
Sunray Study Area until such time as the aforementioned study has been completed and the
Council of the City of Saint Paul has taken action on the recommendations contained therein:
NOW, THEREFORE, BE TT RESOLVED, that under separate ordinance, the Council of
the City of Saint Paul will prohibit on any pazce] of land or part thereof within the areas of the
Sunray Study Area, the issuance or approval of zoning and building pernuts, plat approvals or
lot splits, until the expiration of twelve months as provided in Minn. Stat. § 462.355, Subd.(4), or
until such earlier time as the Council of the City of Saint Paul has taken action on the
recommendations coritained in the study; AND,
BE TT F[IRTHER RESOLVED, that pending the adoption of the interim ordinance
prohibiting any development inconsistent with the pending study and any amendments to the
City's zoning code within the boundaries of the described areas, no zoning or building permits,
plat approvals or lot splits may be issued or approved, unless exempted as provided under the
terms set forth in that same separate ordinance noted above, from this date and until the
expiration of twelve months as allowed by Minn. Stat. § 462355, Subd.(4), or until such earlier
time as the Council of the City of Saint Paul has taken action on the recommendations contained
in the study; AND

BE TT FLTRTIIER RESOLVED, until such time as the said study has been completed and
the Council has reviewed its recommendations for possible adoption, city departrnents receiving
written applications for the approvals noted above shall accept the applications and immediately
process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 and with the
intent of this interim ordinance.
BE TT FTNALLY RESOLVED, that the restricrions contained in this resolution and in the
9 said interim ordinance may be extended by action of the Councii of the City of Saint Paul for
10 those additional time periods not to exceed ihe time provided in Minn. Stat. § 462.355, Subd. (4)
11 in the event such study and recommendations and the deliberations of the Council requires such
12 extensions of time.
