In the matter of hazardous buildings
being that two story frame dwelling known
and described as 1015 Marion in the City of
Saint Paul, situated on those premises
legally described as Lot 1, except the West
52 feet, Block 39, Auerbach and Hand' s
Addition to the City of St. Paul, according
to the plat on file and of record in the
off ice of the Register of Deeds in and for
the County of Ramsey, State of Minnesota
WHEREAS, pursuant to Resolution C. F. 264505, approved October
31, 1974, a public hearing was scheduled for 10:00 a.m. on November
14, 1974 before the Council of the City of Saint Paul, said hearing
pertaining to the condition of the structure located at 1015 Ma.rion,
Saint Paul, Minnesota; and
WHEREAS, upon f�.cts presented at said hearing consisting of
photographs, inspection reports- and the recommendation of the
Division of Housing and Building Code Enforcement, it is found and
determined by the City Council that according to the records and
files in the office of the Register of Deeds, the last record owners
of the above described property are Daniel W. Fourre and Lucille
Jueneman and that there is a mortgage on the property to Midwest
Federal Savings and Loan; and that it is further determined that the
above described building constitutes a hazardous buiiding within the
definition of Minnesota Statutes Section 463. 15 for the following
reasons:
a. The building is standing vacant, abandoned
and is subject to being entered by unauthorized persons;

b. The exterior condition of the building is as follows:
The building has a partial basement with rotten joists that are
pulling away from the basement walls and under part of the first
floor there are 2 x 4' s used as joists. The foundation is sand-
stone and is in need of repair. The windows are broken and the
doors and trim are in poor shape; rotten and with parts missing;
c. The interior condition of the building is as follows:
The floors on the first floor are sagging and the plaster is
cracked and falling. A hole is broken through the paneling in
the fro�t room. The kitchen cabinets have been vandalized.
There is a hole in the chimney on the first floor. The plu�bing,
electrical and heating systems are in disrepair. Some of the
drains on the plumbing system are connected with rubber hoses.
The water piping is leaking. The hot water heating system has
been frozen and the radiators are broken;
d. The building in the above condition is beyond reasonable
repair;
e. The building is unfit for huma.n habitation in its
present condit ion and the above corrections must be made in
compliance with the Building Code and the Housing Code of the
City of Saint Paul in order to ma.ke the same habitable;
f. The building constitutes a nuisance and a hazard to
the public health, safety and welfare because of its physical
damage, dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, that in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby
make the following Order:
ORDER
1. The owners of the above described building shall make the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the ma.terials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of District Court of Ramsey
County, Minnesota within twenty (20) da.ys from the date of the
service of this Order, a Motion for Sununary Enforcement of this
Order to raze and remove the said building will be ma.de to the
Ramsey County Distriet Court;

3. In the event that the building is to be razed by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unreason-
ably interfere with the razing and removal of this building
shall be removed within ten (10) days from the entry of
judgment; and if not so removed, the City of Saint Paul shall
remove and dispose of such personal property and fixtures as
provided by law; �
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above described real estate
and collected as other taxes; and be it .
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners of the above property in the manner provided by law.

Honorable Council:
The Division of Housing and Building Code Enforcement is hereby sub-
mitting its report on the condition of the structure at the location
referred to above.
The owner of record is Wyman F. Fourre.
The legal description of the property is Lot l except W. 52 feet,
Block 39 , Auerbach and Hands Addition.
The building is a two-story frame dwelling. There is a partial base-

frozen and the radiators are broken. The Housing and Redevelopment
Authority does not intend to acquire this property. The subject prop-
erty has been boarded by the owner since April 1, 1974 .
Inasmuch as the inadequate maintenance , the dilapidated condition and
the physical damage outlined above constitute a public hazard and the
owner has made no attempt to satisfactorily repair the damage despite

our warnings , and the continued vacant and boarded up condition con-
tributes a blighting influence on the neighborhood, it is the recom-
mendation of this bureau that this matter be referred to the City
Attorney's office for razing and removal through District Court pro-
ceedings.
