WHEREAS, the Council, by Resolution C. F. 264460, approved
October 24, 1974, approved the petition of Norman B. Mears and
others to vacate the public alley described as Except the North-
westerly 8 feet, the easterly ten (10) feet of Lots 9 and 10,
Block 13, St. Paul Proper; and except the northwesterly 8 feet,
the westerly two (2) feet of Lots 8 and 11 in Block 9, Whitney
and Smith' s Addition to St. Paul, Ramsey County, Minnesota, subject
to the terms and conditions contained therein including the
requirement that pursuant to Section 228.05(e� of the Legislative
Code, all said terms and conditions must be complied with within
thirty days after publication of the vacation resolution; and
WHEREAS, the petitioner has requested that the City Council
extend the time to comply with the vacation resolution which ex-
tension is authorized by the terms of Section 228.05(e� of the
Legislative Code; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does
hereby amend City Cauncil Resolution C. F. 264460, so as to perm.it
the petitioner to comply with the terms and conditions contained
therein for an additional period of thirty days, and the Gity
Clerk is directed to transmit a copy of' this resolution to the
petitioner

Gentlemen:
On the Petition of Norman B. Mears and others the City Council on
October 24, 1974, adopted a resolution vacating the following des-
cribed public alley:
Except the northwesterly 8 feet, the easterly ten (10)
feet of Lots 9 and 10, Block 13, St. Paul Proper; and
except the northwesterly 8 feet, the westerly two (2)
feet of Lots 8 and 11 in Block 9, Whitney and Smith's
Addition to St. Paul, Ramsey County, Minnesota.
This resolution was approved on October 24, 1974, and published
on November 2, 1974 . The vacation was expressly subject to the
following conditions:
1. The granting of the City of Saint Paul a permanent
easement for street purposes.
2. That specific easements be retained to protect the
interests of Northwestern Bell Telephone Company
and Narthern S tates Power Company.
3 . Paying the City $18, 500 as compensation for the
vacation.

4. Filing a bond with the City in an amount of $10,000 .
Chapter 228 of the Saint Paul City Ordinances provides in Section
228.05 (e) that within 30 days after the publicatio n of any vaca-
tion resolution the petitioner shall file an acceptance of the
conditions of the resolution with the City Clerk and shall comply.
with the terms and conditions of the resolution. The 30 day
period expires on Monday, December 2.
As you undoubtedly know, Mr. Norman B. Mears has recently passed
away. Therefore, we hereby request pursuant to Section 228.05 (e)
that the City Council adopt a resolution amending the vacation
resolution so as to extend the time for compliance for an additional
period of 30 days.
