RESOLVED, That the proper city officials are hereby
authorized and directed to pay out of the Tort Liability
Fund 09070-420-000 to Irene Anderson and Douglas B. Fink,
her attorney, the sum of Seven Hundred ($700.00) Dollars
in payment of the judgment that was entered in favor of
plaintiff Irene Anderson and against defendant Walter H.
Wallraff in Municipal Court, City of Saint Paul, plaintiff' s
cause of action arising out of an automobile accident on
September 22, 1970 whereby her vehicle collided with a truck
owned by the City of St. Paul and driven by its employee
Walter H. Wallraff.

SUBJECT: Claim of Irene Anderson v. Walter H. Wallraff
The claim of Irene Anderson arose out of an automobile
accident on September 22, 1970 at the intersection of
Maryland and Greenbrier. She sustained property damage
in the amount of $260.00, medical bills in the amount
of $140.00 and loss of earnings of $96.00 when her
vehicle was struck by a truck owned by the City of St.
Paul and driven by its employee, Walter H. Wallraff.
Based on the facts of the accident, it is my opinion
that Mr. Wallraff was negligent for failing to yield
the right of way to Miss Anderson' s vehicle. Therefore,
I would recommend that the City pay the judgment entered
in her favor and. against Mr. Wallraff who just recently
passed away. The death of Mr. Wallraff did not extinguish
Miss Anderson' s cause of action.
