SCOTT DAVIES TO: Members of the City Council FROM: Daniel L. Ficker �.� t.�� SUBJECT: Claim of Irene Anderson v. Walter H. Wallraff The claim of Irene Anderson arose out of an automobile accident on September 22, 1970 at the intersection of Maryland and Greenbrier. She sustained property damage in the amount of $260.00, medical bills in the amount of $140.00 and loss of earnings of $96.00 when her vehicle was struck by a truck owned by the City of St. Paul and driven by its employee, Walter H. Wallraff. Based on the facts of the accident, it is my opinion that Mr. Wallraff was negligent for failing to yield the right of way to Miss Anderson' s vehicle. Therefore, I would recommend that the City pay the judgment entered in her favor and. against Mr. Wallraff who just recently passed away. The death of Mr. Wallraff did not extinguish Miss Anderson' s cause of action. City Hall, Saint Paul, Minnesota 55102 612 298-5121
