WHEREAS, The Council of the City of Saint Paul, by resolution,
C. F. 263315, vacated portions of Claghorn and Thomas Streets on
the request of the Housing and Redevelopment Authority of the City
of Saint Paul, and authorized the sale of real property owned by
the City of Saint Paul for Scheffer Playground purposes to the
Authority for the sum of $44,000.00; and
WHEREAS� The Department of Community Services desires to
purcha.se the property located at 887 Orcha.rd Avenue from the Housing
Authority to be used far the purpose of expanding Orcha.rd Playground
for the sum of $26, 246.45; and
WHEREAS� IN accordance with the Section 13.04 of the City
Cha.rter, net cash proceeds received by the City from the sale of
City-owned real property sha.11 first be used to retire any out-
standing indebtedness incurred by the City in acquisition or im-
provement of the property and if any proceeds rema.in, sha.11 be
used to fina.nce other improvements in the Ca.pital Improvement
Budget or to retire any other existing bonded indebtedness; and
WHEREAS� The Council is informed tha.t there does not exist
any outstanding indebtedness incurred by the City for the acquisil�n
of Scheffer Playground and that the $44,000.00 proceeds received
by the City may be used to acquire the property for Orcha.rd Play-
ground expansion; and
WHEREAS, The Mayor ha.s submitted a request to the City Council,
that the 1974 Capital Improvement Budget be amended so as to in-
clude the acquisition of the property at 887 Orcha.rd for the purpose
of expa,nding Orchard Play�round, and the Long Ra.nge Capital Improve-
ment Budget Committee of Saint Paul ha.s recommended tha.t the said
1974 Capital Improvement Budget be so amended; now, A�e��, be _ _�

RESOLVED, Tha.t upon the recommendation of the Ma.yor and the
Long Range Ca.pital Improvement Budget Committee of Saint Paul�
and in accordance with Chapter 10 of the City Cha.rter and Cha.pter
66 of the Saint Paul Legislative Code, the 1974 Capital Irnprovement
Bud�et be and is hereby amended so as to add the project identified
as Orcha.rd Playground Expansion", and there is hereby appropriated
the sum of $26,246.45 to the said 1974 Capital Improvement Budget
as herein amended in accordance with applicable provisions of the
City C�-iarter and Legislative Code; and be it
FURTHER RESOLVED� Tha.t the Council of the City of Saint Paul
does hereby authorize the acquisition from the Housing and Rede-
velopment Authority of the City of Saint Paul the real property
located at 887 Orcha.rd Avenue and described as Lots 19 and 20,
Block 32, Thompsons Addition to St. Paul, Subdivision of Block
numbered Thirty-two (32), La.ke Como Villas� for the sum of $26,246.45
upon the receipt by the City of recordable deed in form approved
by the City Attorney, to be cha.rged to Fund No. 3��� 60000 (PIR)
to be reimbursed from Fund No. 50085 (Debt — Capital Improvement)
