WHEREAS, The Council, by Resolution C. F. 264398, approved
October 17, 1974, approved the petition of Norman Mears and others
to vacate the Easterly alley in Block 9, Whit�ey and Smiths Addition
to St. Paul, subject to the terms and conditions contained therein,
including the requirement tha.t pursua.nt to Section 228 .05(e) of
the Legislative Code, all said terms and conditions must be com-
plied with within thirty days after publication of the vacation
resolution; and
WHEREAS� The petitioner has requested tha.t the City Council
extend the time to. comply with the vacation resolution, which ex-
tension is authorized by the terms of Section 228.05(e) of the
Legislative Code; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does
hereby amend City Council Resolution C. F. 264398 so as to permit
the petitioner to comply with the terms and conditions contained
therein for an additiona.l period of �hirty days, and the City
Clerk is directed to transmit a copy of this resalution to the
petitioner.

Gentlemen:
On the Petition of Norman B. Mears and others the City Council on
October 11, 1974, adopted a resolution vacating the following des-
cribed public alley:
The Southwesterly 14 ' of Lots 1 through 6 except for
the Southeasterly 17 ' 4" thereof in Block 9, Whitney
and Smith's Addition to Saint Paul, Ramsey County,
Minnesota.
This resolution was approved on October 17 , 1974, and published
on October 19, 1974 . This vacation was expressly subject to the
following conditions :
1. The granting of the City of Saint Paul a permanent
easement for street and public sidewalk purposes .
2. Entering into an agreement with the City of Saint
Paul concerning the conveyance of an easement for
street purposes in the future.
3. Paying the City $16, 270 as compensation for the
vacation.
4. Filing a bond with the City in an amount of $10 ,000 .

Chapter 228 of the Saint Paul City Ordinances provides in Section
228.05 (e) that within 30 days after the publication of any vacation
resolution the petitioner shall file an acceptance of the conditions
of the resolution with the City Clerk and shall comply with the
terms and conditions of the resolution. The 30 day period expires
on Monday, November 18.
The form of the grant of easement, and the agreement concerning
the future grant of easement have been reviewed with and approved
by Mr. Segal of the City Attorney's office, but need the signa-
ture of Narman B. Mears in order to file them. The compensation
check in the amount of $16, 270 is available for payment to the
City. However, :�r. Mears is out of town and not scheduled to
return for two weeks. Therefore, on behalf of Norman B. Mears ,
we hereby request pursuant to Section 228 .05 (e) that the City
Council adopt a resolution amending the vacation resolution so
as to extend the time for compliance for an additional period
of 30 days .
