TO: Members of the Council of the
City of Saint Paul

RE: Registered Bill Number B02315

The above mentioned registered bill arises out of an
accident which occurred on August 14, 1974, at
West Seventh and Grand Avenue between a City of Saint Paul
truck driven by Ma,rtin Paech and a station wagen driven
by George P. Novak. The Novak vehicle was in the
process of making a left hand turn when struck by the
City vehicle. In this situation, the Novak vehicle
was negligent for failing to yield the right-of-way to
the City vehicle which was proceeding straight on
Grand Avenue. However, under the comparative negligence
statutes, as they exist in the State of Minnesota, the
City driver was guilty of some negligence and this
office has reached a tentative settlement of this matter
at 75/ of the City' s damages. This office recommends
settlement on that basis.
