This written response to the application of Vadnais Development �
Corporation for a permit to install a 270-car parking lot on property
located on the north side of Hoyt between Westminster and Arkwright. i
This property is further described as follows: !

. This ir�atter was heard by the Board of Zoning on March 21, 1974, ar which �
time staff explained a parking facility for this property was previously !
approved but the p1_an had been changed. Because of ponding and sewer `
easement problems, staff recommended this matter be tabled pending an �
a�reement between the developer and Ptiblic Works on the existing problems. ;
A metion by the Board to table this matter carried unanimously. �

This was again heard on May 2, 1974, at which time staff again recommended j
this be laid over until the storm water ponding question had Ueen resolved. �
A motion �vas again made and unanimously carried to table this matter until {
ttie iirst meeting in July. i

'ihis matter was again heard on September 5, 197�+. Staff reco}nmended
approval of the permit stati_ng that the engir.i2ering and design problems
had been met.

There was discussion among the Board members and neighbors about how
the storm water drainage problem had been solved. It was also explained
that the Environmental Assessment is to determine whether an Environmental ?
Impact Study is required and that the Environmental Quality Council does =
have the right to rule nulifying any actions taken. }

A motion to recommend approval of the permit carried unanimously. ;
Plans received April 18, 1974, meet design standards.

A. HISTORY: This property was rezoned from "A" Residence to "C" Residence at two
separate times. The portion east. of Edgemont Street was rezoned by three
separate petitions in November, 1970. The portion west of Edgemont Street was
rezoned in December, 1971. A permit for a 338-car parking lot was �granted in
January of 1973. However, subsequent revision of plans has reduced �the number
of dwelling units on the site. The present proposed facility is for a 270-car
p�.'.cing lot. -
B. AREA ZONING: At the southeast corner of Hoyt and Mississippi is a "C-1"
Residential district, south of which is a "C" Residence district. South of that
is a Light Industrial district. Commercial districts exist on both sides of
Wh��1�^_k Park�oay at the freeway ramp. A "C" Residential district exists at the
southeast corner of Larpenteur Avenue and Sloan Street. The rest of the area is
zoned "A" Residential.
C. Dr,SIGN STA�ARDS: Revised plans received April 19, 1974 meet design standards.
D. FRONTAGE A:�ID aREA; This parcel has a frontage of 400 feet along 6Jestminster, 370.5
feet alcng E. Hoyt Avenue, about 460 feet along the portion of Edgemont Street
not being vacated, and about 375 feet along ��lheelock Parkway. The total area with
- the vacated streets �oi11 be 249,952 square feet.
F'. SITE CO`�7ITI�\S: The site is vacant and varies in heig�t rnlative to !•7estninster
St-reet . Some of the land is from 3 to 6 feet �elo��� Glestninster while the south-
easterly ;�ortion is nilly. The lo�a portion has received some grading.
F. AR_F,A C�\DITI�`�: The area south of �Io}-t Taest of ti•7estminster is developed taith
apartments. The Soo Line tracks adjoin the site on the east. The general area
on either side of these tracks is about half vacant and half developed with single
family homes.

Dear Mrs•. Mix:
Enclosed herein i� a resolution granting the applica-
tion of Vadnais Development Corporation for a permit
to install a 270 car parking lot on property located
on the north side of Hoyt Avenue between Westminster
and Arkwright Streets. Pursuant to your request and
the request of the City Council, a condition has been
added to the resolution subjecting the permittee to
compliance with any and all conditions imposed by the
Metropolitan Sewer Board when it granted Vadnais
Development Corporation the right to connect to the
sewer owned and operated by the Metropolitan Sewer
Board. In your letter requesting that this office
prepare the resolution, you requested that this reso-
lution contain "�, ; � any other conditions that could
be considered legally." Unless this office is advised
as to any specific conditions that the Council determined
to be necessary in the granting of said special use
permit, this office is assuming that the standard
resolution granting parking permits wherein the permittee
is required to comply with all laws and ordinances is
sufficient. The concern that Vadnais Development
Corporation comply with the Environmental Quality
Council' s regulations is contained in the part of this
resolution which requires the permittee to comply with
all laws and regulations and ordinances. A violation
of an environmental law or regulation would be ground
for revocation of the special use permit.

There was discussion among the Board members and neighbors about how
the storm water drainage problem had been solved. It was also explained
that the Environmental Assessment is to determine whether an Environmental
Impact Study is required and that the Environmental Quality Council does
have the right to rule nulifying any actions taken.
A motion to recommend approval of the permit carried unanimously.
Plans received April 18, 1974, meet design standards.

A. HISTORY: This property was rezoned from "A" Residence to "C" Residence at two
separate times. The portion east of Edgemont Street was rezoned by three
separate petitions in November, 1970. The portion west of Edgemont Street was
rezoned in December, 1971. A permit for a 338-car parking lot was ,granted in
January of 1973. However, subsequent revision of plans has reduced-the number
of dwelling units on the site. The present proposed facility is for a 270-car '
parking lot.
B. AREA ZONING: At the southeast corner of Hayt and Mississippi is a "C-1"
Residential district, south of which is a "C" Residence district. South of that
is a Light Industrial district. CoIIanercial districts exist on both sides of
Wheelock Parkway at the freeway ramp. A "C" Residential district exists at the
southeast corner of Larpenteur Avenue and Sloan Street. The rest of the area is
zoned "A" Residential.
C. DESIGN STAiVDARDS: Revised plans reeeived April 19, 1974 meet design -standards.
D, FRONTAGE AND r�REA: This parcel has a frontage of 400 feet along Westminster, 370.5
feet along E. Hoyt Avenue, about 460 feet along the portfon of Edgemont Street
not being vacated, and about 375 feet along Wheelock Parkway. The total area with
the vacated streets will be 249,952 square feet.
E. SITE CONDITIOVS: The site is vacant and varies in height relative to Westminster
Street. Some of the land is from 3 to 6 feet below Westminster while the south-
easterly portion is hilly, The low portion has received some grading.
F, AREA CONDITIOV: The area south of Hoyt west of Westminster is developed with
apartments. The Soo Line tracks adjoin the site on the east. The general area
on either side of these tracks is about half vacant and half developed with single
family homes. ,

Soil limitations are expressed as SLIGHT, MODERATE, SEVERE, A1�TD

proper planning and management. SEVERE limitations often require
special design and maintenance measures. VERY SEVERE limitations
are very difficuit or impractical to overcome. Special design
and expensive reclamation may be needecl.

"Li.mitations For Foundatiens For Low Building" depend mainly on
the bearing capacity and shrink-swell of the soil.. Slope and
erosion were not taken into account in determining the ratings.
� The depth to which a foundation is placed is determined mainl�
. by the depth at which it is affected by frost heaving. (4 to 5
feet in central Mf.nnesota} There£ore, foundations are placed in
• the substratum o� the soil and it is this material that is eval-
uated in this column.
The presence of ground water is �onsidered in the ratings. Wet
soils with a good bearing capacity are rated severe because of
the over-riding wetness factor.
"Water Holding Capacity" is a feature of the soil that should
be considered in regard to vegetative cover. These ratings are
an indication ot ease for establishment and maintenance of turf,
ahrubs and trees for landscaping, etc.
"Other Features" includes depth to bedrock, stoniness, water
ponding and subject to f rost heave.

EVALUATION: The area colored yellow has moderate limitations
� for urban uses (building sites and streets) . The limiting
� soil conditions are due to slope and requires land grading
,
to overcome the limitation.
The area colored red has verv severe limitations due to
high seasonal water table and low bearing capacity. This
area consists of deep (60 inches plus) organic soils.
Organic soils have a seasonal water table which is near or
above the surface. They have a low density and are highly
shrinkable when drained. The initial shrinkage (subsidence)
upon dewatering or drainage will range from 30 to 90 per
cent of its volume. These characteristics are responsible
for structural failures of foundations for buildings, roads,
bridges and parking lots. Excessive expense is incurred
to overcome these soil conditions.

Dear Ms. Hunt:
The Environmental Quality Council has received a petition requesting an
�nvironmentaZ Impact Statement on the excavation of land, the changing
of natural ponding areas, and the building of apartment buildings>:on .
properties located within an area of St. Paul bounded by Larpenteur Avenue'
to the North, Interstate 35E to the West, Maryland Avenue to the South,
and Edgarton Street to the East. The petitioners specifically emphasize
their concern about alterations to the existing drainage pattern and associ�-
ated high�density residential development in an area adjacent to Hoyt Street,
between Westminster and Arkwright Streets, and between Wheelock Parkway and
Arlington Avenue. It is my understanding that the developmant of this letter
area is being carried: out by Sherman R:- Rutzick & Assaciates and by Harold
B. Pokmo, Jr. , of the Vadnais Development Company.
Following the receipt of sucYc a petition, the Environmental Qu.ality-Council
must order the preparation of an Environmental Assessment on the proposed
action, unless such action is exempt. In this case, it appears 2ikely that
the apartment building proposed by Rutzick and Associates et al may be ex-
empt from the requirement of an Environmental Assessment, pursuant to
Section riEQC 26(c) (4) (bb) of the enclosed Ru1es and Regulations for En-
vironmental Impact Statements. .
However, there is no provision for exemption of action proposed by public
agencies. It is my understanding that the City of St. 'Paul, �epartment of
Public Works, is contemplating the construction of alterations to the drain-
age pattern in order to facilitate construction of the apartment buildi.ng
proposed by Rutzick & Associates et al. If this is true, the preparation
of an Environmental Assessment would probably be required by the Environ-
mental Quality Council.
Further, the reguZations stipulate that when a proposer of an action is a
public agency, that public agency shall be designated the preparer of the
Environmental Assessment. In this case the City of St. Paul would be. re-
sponsible for preparation of the Environmental Assessment on the proposed
drainage groject.

next regular meeting on July 9, 1974. At that time the Environmental Quality
Council will likely address two questions: 1) whether the construction of the
apartment building itself is exempt from the requirement of an Environmental
Assessment; 2) whether the City of St. Paul must prepare an Environnentai
Assessment on the stormwater ponding proposal, if approved.

CHAPTER ELEVEN
AUTHORITY , PURPOSE, DEFINITICNS , GENERAL PROVISIONS
MEQC 21 AUTHORITY
Ttie Regulatipns contained herein are prescribed by the
Minnesota Environmenta7 Quality Counci7 , pursuant to
authority granted in Minnesota Stat!�te� , Section 116D. 04 ,
Subdivision 'l. These Regulations sha17 be followed by
public agencies and priva�te persons in the implementation
of Minnesota Statutes , Section 116D. 01 et sec� . , herein
referred to as the Environmental Po7icy Act of 1973.
MEQC 22 pURPOSE
�a ) The purpUSe �f these Regulations is to provide pub7ic
agencies and pri ��ate persons with principles , objectives ,
criteria and definitions of statewide application to be
used in the implementation of the Minnesota Environmental
Impact Statement proqran7 ; imp7ementation includ�s �he
evaluation of proposed actions and the preparation and
review of environmental impact statements .
�b ) It is intended that an EIS shall be an informationa7
document that enables environmenta7 constraints and
� opportunities to be considered in the development of
. an action. It sha71 � nform public and private decision-
makers and the pub7ic of the environmenta7 effects of
actions that have been proposed.
�� � An EIS is not intended as an instrument to justify an
actian , nor shali indications of adverse environmental
effects necessarily require that an action be disapproved.
MEQC 23 DEFINITIQNS
The following terms as used in these Regulat�ons shall have
the following meanings :
�a ) "Act" means the Minnesota Environmental Policy Act ,
Minnesota Statutes , Section 176D. Oi et seq.
�b ) "Action" means any activity with the exception of the
foilowing :
. �� ) An action specifically exempt�d from these
Regulations by law.
�2 ) Legislative proposals and enactmen�s of the State
Legisla�ture.
(3 ) Continu �ing internal operations or maintenance
activities .
(4 ) Emergency repairs to public service facilities .
. (5) Rules , regulations , and commissioners ' orders .
(6 ) Su�missions of proposa] � to a vote of the people
of the State.
(c) "Counci ] " means the Minnesota Environmental Quality Council .
�d) "Days . " In computing any period of time prescribed or
allowed in these Regu7ations , the day of the act or the
event from vrhich the designated period of time begins to
run shall not be included. The last day of the period
so computed sha71 be inc7uded , unless it is a Saturday ,
a Sunday , or a lega7 holiday , in which event the period
runs until the end of the next day which is not a Saturday ,
a Sunday , or a lega7 holiday. When the period of time pre-
scribed or allowed is less than 15 days , intermediate
Saturdays , Sundays , and 1ega7 holidays sha71 be excluded
in the computation. '
�e) "Draft EIS" means the basic document for review and comment
on the environmental effects of a particular action.
�f) "Environment" means the to�ality of man ' s surroundings ;
both social and physica7 , both natur•a7 and man-made ,
including human , plant , and animal communities , and
the forces that act on them.
�9 ) " Environmental Assessment" means the study to determine
if an action is a major governmental action or a major
private act�ion of more than local significance and if it
may have the potential for significant environmental
effects .
�h ) "Environmenta7 Effect " means an impact , Hhether immediate '
or delayed , on any component of the environment.
�� ) " EIS" means Environmental Impact Statement , an analysis
of a proposed major action and written report based
thereon.
�J ) "EIS Completion Notice" means a form filed with the
Council by a Respons� ble Agency or Responsible Persan
immediately upon the completion of a Draft or Final EIS .

( F: � " EIr Pr�e�aration Pdotice" means a br. ief written si;ai:ement
� � that a major act� on has the potential for sianif� cant
� environmental effects , and that an EIS sha] 1 be prepared .
.
(7 ) " Existinq Flction" means an action that was commenced
before January 1 , 1974.
(m) "Governm�ntal Action" means an action proposEd by a .
public agency.
(n ) "Governmental Permit" means a lease , permit , license ,
certificate , variance , ar other entit7ement of �ase , or
the commitment to iss�►e ar the issuance of a discre-
tionary contract , grant , subsidy , 7oan or other form
of financial assistance , by a public agency to another
pub] ic agency or to a priaate person.
(o ) '° Inadequate EIS" means an EIS th�t fai7s to sufficiently
examine potential �nvironmental effects , alternatives ,
desirable modifications , procedural reQUirements , and
other factors required of an EIS by the Act and these
Regulat� ons .
(p ) "Materia7 Evidence" means evidenGe that is important
and relevant to the determination of whether an action
is a major governmenta7 action or major private action
of more than local sign9ficance and has the potentia7
for significant environmenta7 effects .
�9 ) "New Action" means an action that was commenced after
January 1 , 7974.
"�►") "Person" means a human being , firm, association , or-
ganization , partnership , business , trust , corporatior� ,
� or company.
{� ) "Pet� tian" means a document that contains at least
500 signatures and requests the preparat� on of an FIS.
�t� "Potentia7 " means existing in possibility , but not
proven in fact.
. �u � " Proposer" means the private person or public agency
that proposed the action that may be subject to an EIS.
��) " Private Action" means an action proposed by a private
person.
�w) "Public Rgency" means , but is not limited to , state ,
regional , or local agency , board, commission , or
unit of government. It does not include the courts
of this State.
(x ) "Regulations " means the Environmental Quality Council ' s
Environmenta] Impact Statement Regulations .

�Y) "Responsible �gency" means the public agenc,y that is
responsib] e for the � preparation of an EIS or Environ- _
mental Assessment.
�z ) "Responsible Person" means the person who proposed
an action that does not reguire a governmenta7 permit
. and is responsible for rhe preparation of an EIS.
��a ) " Reviewing Agencies" mear,s all public agencies which
have jurisdiction by law or specia7 expertise with
regard t.o the environmenta7 effects of an action
for which an EIS is prepared .
(bb ) ��Signi �icant" means considerable and important.
MEQC 24 GENERAL RESPONSIBILITIES
�a ) Environmenta7 Quality Counci7 .
�� ) The Council sha71 be responsible for the function
and coordination of the EiS program.
�Z) Before July 1 , 1975 , the Council shal ] review the
EIS program and these �egu7ations to determine
their adequacy in meeting the requirements of the
Act and , if necessary , sha71 revise these Regulations .
�b) Public Agencies . . .
�� � All pub7ic agencies sha77 comply with the requirements
of the Act and these Regulations .
�2� All public agencies sha17 retain their existing
statutory authority subject to the substantive
polic�es in the Ac� and the authority of the
Counci7 to reverse or modify d�cisions or
proposa7s .
�3� These Regu7ations sha71 not affect the specific '
statutory obligations of any state agency to
perform the following :
(aa ) to cornply with criteria or standards
of envi ronmenta7 qua7 � ty ;
(bb ) to coordinate or consult with any
federa7 or state agency ; or
(cc) to act or refrain from acting con-
tingent upon the recommendations or
certification of any other agency or
� federa7 agency.

(4 ) A public agency , at the reques � of a RESponsib� e
Agency , shal i provide any� data that it. may have
concerning the particular action and sha71 assist
in the preparation of any parts of an EIS an whic��
it has specia7 expertise or access to information. �
�5 ) All public agencies �"all endeavor to make available ,
upon requesL , officza7ly filed EIS materials fr�e
of charge , to the fullest extent practicab7e , or
at a fee that is noi more than ti�e agency ' s actua1
� re�roduct� on cost.
�� ) Private Persons .
When an Environmenta7 Assessment or an EIS is required
on a private action that �s subject to a governmenta7
permit , the proposer sha71 supply in the prescr� bed
manner any data or infor�mation requested by the Respon-
sible Agency in the preparation of the environmental
assessmeni; or EIS that that person has in his posses-
sion or to which he has reasonable access .

�HAPTER TWELVC '
PROCEDUR�L ASPECTS OF TNE PRFPARATION
OF AN EPJ�IRONMENTAL IMPACT STATEMENT
MEQC 25 ENVIRONMENTAL ASSESSMENT
�a ) Purpose. The purpose of an environmenta7 assessmer�t
is to assist the Council in determining the ne�d to
prepare an EIS . It shall be prepared as early as
possible in the deve] opment of an action and before
an EIS shall betrequired .
�b ) Requirement of an Environmenta7 Assessment. An
Environmenta7 Assessment shall be prepared in the
following instances :
• �� ) When a proposer decides to prepare an Environmer+tal
Assessment ;
��2 ) When the proposed new action falls within any of
the followino categories :
(aa ) Construction of e7ectric generating plants
at a single site designed for , or capable
of , operation at a ca aci �y of 200 or more
megawatts (e7ectrica7 � ;
(bb ) Construction of electric transmission lines
and assoc�ated faci � ities designed for , or
capab7e of, operation at a nomina7 voltage
� of 200 ki7ovo7ts AC or more , or operation
at a nominal voltage of +200 kilovo7ts DC
or more , and are 50 mi7es or more in length ;
(cc) Construction of a faci7ity or integral group
of facilities with at least 500 ,000 square
feet of commercial or retail floor space or
350 ,000 square feet of industrial floor space , �
unless located in an industria] park for
which an EIS or Environmental Assessment has
already been prepared ;
(dd) Construction of a new oil refinery , or an
expansion of an existing refinery that shall

its preparation or within 45 days after notice to
the Counci7 of a dec� sion to prepare an assessment

may grant a single time extension of 15 days . The
prepar�er sha71 also distribute the assessment to

(cc ) Construction plans or insta7lation permits
for an action have been approved by the ap-
propriate public agencies before January 1 ,

governmental permits before January 1 , 1974 ,
to commence constructian or imp7ementation

(5) When an imminent and substantia7 danger to the
health or we7fare of the people of the State, or
any part thereof , makes it necessary to undertake '
a major action that has the potentia7 for signif-
icant environmenta7 effects, the proposer
sha71 consult w� th the Chairman of the Counc� l
to arrange an a7ternate means of environmental
review. In an emergency , the proposer shal ��,
as soon as practicable, but not less than 30
day, thereafter, notify the Council of the action
. taken and its environmenta7 consequences . .

�� ) New Actions . 4�hen ar. EIS is required on a new action ,
any physica] construct� on on the action sha71 be ha7tE�d
fr�m the t�me the EIS Preparation Notice is mai7ed to
the proposer until the Fina7 EIS is accepted by the
Council , un] ess the Counci7 determines that construc-
tion may begin or co�tinue. In that case , the Councii
� shall specify the extent to which construction shall
be allowe�.
(2) Existing Act� ons . When an EIS is required on an exis�-
. ing action , physica7 construction sha71 be permitt�d
to cont� nue unless the Council orders the construction
halted . Construction that the Courci7 has ordered
discontinued sha71 not be resumed unti7 the Counc� �
so orders or unti7 the Fina7 EIS is accepted by the
Coun�� l , whichever occurs f9rst.
(f) EIS Preparation Notice. When the Council determines �hat
• an EIS shall be prepared , it shall mai7 the EIS Preparation
Notice to the Responsib7e Agency or Responsible Pereon ,
the proposer , a71 appropr� ate Council -designated dis-
tribution points , reviewing agencies , and , to the extent
practicab7e , to requesting persons .
�9 ) Preparation of Draft EIS. In the preparation of the Draft
EIS :
� � ) The Responsible Agency sha71 consult with a71 public
agencies that must issue a governmental permit on the
action to insure that the EIS reflects the concerns
of all the public agencies invo7ved . This consu7-
tation sha11 be done at an early stage in the prepar-
ation of an EIS . The Responsible Agency ar Respon-
_ sible Person may consult with public agencies that
have special expertise with regard to the potential
environmental effects .
�2 ) 7he Responsible Agency may require the prop�ser tr�
submit any relevant ciata or information that the
proposer has in his possession or to which he has
reasonab7e access .

copies of the Draft EIS and EIS Completion Notice
to all appropriate Counci7 -designated d�istribution
points , reviewing agencies , the proposer and , to
. the extent practicab7e , requesting persons and
the general pub7ic.

. Agency or Responsible Person. However , such extension

the requirements of these Regulations and shal ] be con-
sidered an except�on to n�rma7 operating procedure.
�J } Revi ew of Fi nal EIS.
(1 ) Filing of Final EIS. When the Fina7 EIS has been
completed , the Responsib7e Agency or Responsible
Person shall fi7e with the Council the Fina7 EIS
and the EIS Completion Notice for the Final EIS ,
and sha71 distribute copies of the Fina7 EIS and
. Notice of Completion to all apprepriate Council -
designated distri.bution points , reviewing agencies ,
the proposer , pub7ic agencies , and persons that
commented on the Draft EIS , the, Gouncil ' s Citizens
� Advisory Committee , an�", to ti�e ex-cen�- pra-c't�ica►,le ,
to requesting persons .
(2 ) Council Review.
(aa ) The Council sha71 have the authority to review
all Final EIS ' s .

inadequacy and sha77 specifically identify the
improvements or additions necessary for Council
acceptance of the Final EIS. The Responsible
Agency or Resp�nsib7e Person sha71 have 30 days
to correct the Fina7 EIS. The Counc� 7 may grant
a time extension. However , the extension shall
be the minimum considered essential to revise
. } the EIS to meet the requirements of these Regu-
lations and sha71 be considered an exception to
� normal operating procedure.
�4) Final Decisions .
The Final EIS sha71 prece�e final decisio��s on the
proposed action and sha71 accompany the propc,sed
action through any administrative review process .

appoint that� pub7ic agency as the Responsible Agencv ;
�b ) When the proposer is more than one pub7ic agency or is
a private person who requ�res governmental pPrmits on
his action , the Counci7 sha71 select a Responsible
Agency according to the following guidelines :
�1 ) The publ � c agency with the greatest respansibility
for supervising or approving the act� on as a whole ;
�2 ) The public agency that can most adequately fulfill
� the requirements of the Act and these Regu7ations ;
(3 ) The public agency that is to act first an the
acti on; �
(4) The public agency that has sneci�l exn.pr�t�se
� or access to informat�on ;
t5 ) The Extent ef participation of each pub7ic agency
in the action .
�� ) When the proposer is a private person , and there are no
governmental permits involved , the Counc� l shall appoint .

The EIS Preparation Notice sha71 contain the following :

urban area. �
- Of particular emphasis, the propos�d an3 er.suing action
of the responsible parties will afiect the ponding area as set
forth in Paragraph �I above, which contains considerable op�n
water which is: fringed with� aquatic vegetation. These ponds are _
generally coniined by. steep bridges on two sides and connected
by grass-covered overflo�v water`,��ay areas. These ponding areas
provide storm water, sewage and nutrient and sediment �iltering.
They also provide valuable habitat for a variety of wildZife,
as �aell as being used by local residents for ice skating during
the winter months. Inasmuch as storm water runaff is a major _
concern in url�an areas, and although costs are expended in an
attempt to get rid of the water, nature has in many instances
provided ponds and drainage �aays �•�hich provide for storage and ,
natu-ral release of the storm water. These ponding areas ai.so
allow for nutrient uptake and sediment reduction, thereby im- .
proving the quality of the runoff �aater prior to thQ tim�z tne
�Nater discharges to the lakes and streams. Also, in the urban
area, open space is �a valuable yet decreasing co,-nmodity, and water
areas are an irreplaceable resource. Therefore, preservation of _
these areas would enhance the community of whic� they are a part. �
The smaller ponds, which provide a degree of wi�.dlife habitat
in and of themselves, also become even more va�uable when re-
l�ted to other ponding areas, lakes and � streams. The elimina-
tion of on� small body of water may in itself atipear insi.gnifi-
cant, however, these areas as related to others do have great �

An additional affect of allowing the City of St� Paul
� to encourage and othenaise acquiesce in t�ie chanc�ing o f the
residential neighborhood to a neigh�orhood of high-density

pollution eminating from 35E, and the same �,rill not be abated
with equal vigorance, if at all, v�ith the growth of more apart-
me��t buildings, and other multi-family units. Attached hereto
aiid nlaae a paxt hereof is Exhibit A, which is a ]_etter from the
� l��innesota State Highway Department ���hich explicitly relates that
if the City of St. Paul is alloV�ed to re-zone to a high-density
� of apartmen•t buildings, tYte Hightvay Department would assign a
much lower priority number regarding sound pollution abatement, _
even tYiough there would be more individuals residing close to
the sound po1_lution (along 35E) .
D. The pro�Tisions of the FnvironmenLal Poli.cy Act
that are bezng viola�ted and cahich ma�T be violated by allo�aing
the City of St. Paul to change its zoning ardinance, thereb�r
changina the area described in Paragraph I from a primarily .
