and described as 798 Iglehart and
situated upon those premises
legally described as Lot 4, Block
5, Edwin Dean' s Subdivision of
Part of Smith and Lott' s Out lots
to the City of St. Paul, Ramsey
- County, Minnesota, according to
the plat thereof on file and of
record in the office of the Register
of Deeds in and for the County of
Ramsey, State of Minnesota
WHEREAS, pursuant to a resolution, C. F. No. 262978, approved
January 24t 1974, a public hearing was scheduled for 10:00 a.m. on
Janua.ry 31, 1974 before the Council of the City of Saint Paul, said
hearing pertaining to the condition of the structures located at
798 Iglehart, Saint Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and recommendations of the Division
of Housing and Building Code Enforcement , it �s found and determined
by the City Council that according to the records and files in the
office of the Register of Deeds, the last record owner of the above
described property is Donald A. Nichoison and that there are no lien
holders of record; and that it is further determined that the above
described buildings constitute hazardous buildings within the meaning
� of Min�.esota Statutes Section 463.15 for the following reasons:
a. The building is stariding vacant, abandoned,
and is subject to being entered by unauthorized persons;

b. The exteri+�r condition of the building is as
, follows: The roof of the dwelling sags and is deteriorated
and the cornice and trim are loose and missing. The front
i and rear steps and porch are rotted and the steps are brok�n;
c. The interior condition of the building is as
follows: The first floor joists have dry rot. The floors
are broken and sagging. Plaster is loose and fallen. The
; doors and window frames are broken. The plaster on the

and sagging. The electrical, heating and plumbing systems
have been vandalized. Fixtures have been removed and some
are broken;
� d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in its
present condition and the above corrections must be ma.de in
compliance with the Building Code and the Hot�rsing Code of the
City o� Saint Paul in order to make �he same habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical damage, dilapidation and ina.dequate ma.intenance;
g. There is a frame garage on the property which is
in a state of collapse. There is no support for the roof or
the garage doors;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463.15 through- 463.26, and based upon the foregoing
" findings of the City Council, the Council of the City of Saint
Paul does hereby m�.ke the following Order:
ORDER
1. The owner of the above described building shall make
the same safe and not detrimental to the public peace, health, �
safety and welfare by having the said building razed and the
ma.terials therefrom removed from the premises within thirty (30)
days fronn the date of the service of this -0rde�;

2. Unless such corrective action is taken to comply with
this Order or an an�wer served upon the City of Saint Paul and
filed in the Office of the Cler k of District Court of Ramsey
County, Minneaota.,_ within twen�y (20) days from the date of the
service of this Order, a Motion for 5unanary Enforcement of this
Order. to raze and remove the said buildings will be ma.de to the
Ramsey County District Court;
3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court!
all personal property or fixtures which ma.y unreasonabl inter-
fere with the razin and removal of these buildings sha�l be
removed within ten �10) days from the entry of judgment; and if
not so removed, the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs e�ended by the
City will be assessed against the above described real estate
and c�llected as other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution

Honorable Council:
The Division of Housing and Building Code Enforcement is hereby
submitting its report on the condition of the structures��at the
location referred to above.
The owner of record is Donald A. Nicholson.
The legal description of the property is Lot 4, Block 5, Ed Deans
Subdivision.
The buildings are a 19 ' x 45 ' two story frame dwelling and a 20 'x
20` frame garage.
The roof of this dwelling sags and is deteriorated and the cornice
and trim are loose and missing. The front and rear steps and porch
are rotted and the steps are broken.
The first floor joist have dry rot. The floors are broken and
sagging. Plaster is loose and fallen. The doors and window frames
are broken.
The plaster on the second floor is also broken and fallen. The
floors are rotten and sagging.
The electrical, heating and plumbing systems have been vandalized.
Fixtures have been removed and some are broken.
The frame garage is in a state of collapes. There is no support
for the roof or the garage doors.
The Housing and Redevelopment Authority does not intend to acquire
this property.

Re: 798 Iglehart
The Department of Fire and Safety Services recommend that these
structures be wrecked and removed, as they are hazardous to the
fire fighters.
The subject property has been boarded up by the city since December
11, 1��73.
Inasmuch as the physical damage and dilapidated conditions out-
lined above constitute a public hazard and the owner has made no
attempt to satisfactorily repair the damage despite our warnings,
and the continued vacant and boarded up condition contributes a
blighting influence on the neighborhood, it is the recommendation
of this bureau that this matter be referred to the City Attorney's
office for razing and removal through District Court proceedings.
