2 Preliminary and Final Plat Approval for Darmer Addition
WHEREAS, Steven Darmer, has submitted for City Council approval the attached preliminary and fmal
plat for subdivision of property at 569 and 575 McKnight Road between Mailand Road and Burlington Road
to create 2 residentiallots; and
8 WHEREAS, staff in appropriate City departments have reviewed the proposed plat and have found that
9 it can meet the requirements set forth in Saint Paul Legislative Code Chapter 67 provided that certain
10 conditions recommended by staff are incorporated into the plat; and

12 WHEREAS, notice of a public hearing on the proposed plat to be held before the City Council was duly
13 published in the official newspaper of the City, and notices of the public hearing were also mailed to each
14 owner of affected property including all property situated within 350 feet of the subj ect property; and
15
16 WHEREAS, the City Council conducted a public hearing on the proposed plat on 5eptember 4, 2002,
17 where all interested parties were given the opportunity to be heard and the Council considered all the facts
18 and recommendations conceming the plat;

20 NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached
21 preliminary and final plat far Darmer Addition, to create 2 residential lots at 569 and 575 McKnight Road
22 subject to the following conditions:

24 1. The applicant shall make corrections to the final plat as noted on the plat by public works.
25
26 2. That the applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County
27 Recorder's Office.

�. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2%2 acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land.
§67.406 provides criteria for review of subdivision appiications. These criteria are covered
below under "Required Findings."
F. HISTORY/DISCUSSIQN: none
G. DISTRICT COUNCIL RECOMMENDATION: None received at the time staff reported was
submitted.
H. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that all of the foliowing
findings shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislafive Code are complied with. City staff
have reviewed the proposed plat and have determined that all applicable provisions of
� city codes are met.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed plat is consistent with the surrounding land
uses, and wiil not be detrimental to present and future use of surrounding land.

3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. The area
surrounding the proposed plat is already developed and compatible with the proposed
plat.
4, The subdivision is in conformance with the comprehensive plan. This p(at is in
conformance wifh the comprehensive plan which calis for residen6al land use and
development for this site.
5. The subdivision preserves and incorporates the site's important existing natural
features whenever possible. This subdivision will preserve the e�osting natural
features of the site since no construction or alteration of the landscape will take piace..
6. AIi land intended for building sites can be used safely without endangering
residents by peril from floods, erosion, continuously high water table, severe soii
conditions or other menace. The site is a relatively flat, fully developed area with .no
flooding, erosion, high water table or soil condition problems.
