RESOLVED, that the Council of the City of Saiot Paul does
hereby adopt as its policy that the cost for tree reawval due to
sidewalk construction ar�d reconstruction shall be paid from City
Funds and not assessed against adjoining property and that this
policy shall apply to all sidewalk levies not yet ratified by City
Council and to all future sidewalk construction and reconstruction
levies f rom and after the date of this resolution. The policy is
more fully detailed in the attached writte� policy recaamendatio�
dated June 24, 1974 whicM is made a part of this resolution by
reference.

Dear Mayor Cohen:
The City Council recently asked the Department of Public Works and the
Department of Finance and Management Services, Valuation and Assessment
Division to study the current policy of assessing the property owner one-
half the cost of tree removal due to sideNalk construction or reconstruction.
I have met with the following parties and they concur in the attached
recamnendation and resolution:
Robert Trudeau, Director of Finance, J. William Donovan, Valuation
and Assessment Division, Lloyd Burkholder, City Forester, Jerome Segai ,
City Attorney, Roger Mattson, Budget Director, Robert Pirum, Superintendent
of Parks and Recreation and Hartley Thomas, Supervisor, Sidewalk Division.

' THE REMOVAL OF TREES DUE TO SIDEWALK
CONSTRUCTION
This recommended policy is based on certain assu�tions:
(1) Sidewalks are a desirable improvement
within the City a�d a necessity to
eliminate the need to walk in streets.
(2) It is also desirable and beneficial to
have trees adjacent to the street.
�3) Sometimes it is deemed necessary to
remove existing trees during sidewalk
construction.
(4) Tree removals do not necessarily con-
stitute a special benefit to abutting
property� therefore, these costs shouid
be paid for out of a City fund and not
assessed against the abutting property.
The previous policy was for the Cfty to
pay for one-half of these costs f rom
City funds.
(5) The costs for tree �emoval done in
previous years and not yet assessed is
_ estimated at $5,000.00.
(6) Costs for tree removal on contract
based on 1974 contract prices is esti-
mated to be $7,000.00.
POLICY FOR ASSESSMENTS
Therefore, the recomnended assessment policy for tree rernoval due to sidewalk con-
str�ction and reconstruation is that the costs for tree removal be funded f rom
Public Improvement Aid Funds and that the property owner will not be assessed for
this work. This policy shauld apply to all sidewalk levies currently before the
City Council for ratification and to all future sidewalk levies.
