WHEREAS� The Council of the City of Saint Paul, by Resolution
, C. F. 263398, adopted April 17, 1974, concurred in the recommenda-
'� tion of the Council' s Public Works Subcommittee and authorized the
City Attorney to file a petition with the Minnesota State Department
� of Fublic Service, requesting an Order of the said department
I authorizing the maintena.nce of the existing highway-railroad grade
crossing located at the point where Alton Street crosses the
Chicago, Milwaukee, St. Paul and Pacific Ra.ilroad Compa.ny's Ford
Line Spur Track, and further requesting the installation of ade-
qua.te safety devices at this crossing; and
WHEREAS� The Council's Subcommittee on Public Works does now
; recommend tha.t the City withdraw its said petition and that the
' City and its Depa.rtment of Public Works continue to study the street
needs in this area of the City in conjunction with the proposed
development of the property in the vicinity presently owned by the
Stuart Corporation; and
� WHEREAS� The City of Saint Paul has been previously ordered
by the Minnesota Department of Public Service to close the said in-
� tersection of Alton Street and West Seventh Street; now� therefore�
be it
I' RESOLVEDt That the Council of the City of Saint Paul does here-
by concur in the recommendation of the Depa.rtment of Public Works
and the Council' s Subcommittee on Public Works and does hereby
direct the C.ity Attorney to file with the Minnesota Department of
Public Ser�rice the request on beha.lf of the City of Saint Paul to
�'~� withdraw its petition, and the Mayor and the Department of Public"
Works are hereby directed to proceed forthwith with the closing of
the Alton crossing with West Seventh Street in accordance with the
order of the Minnesota State Department of Public Service.

, Dear Mr. Hozza:
The Public Works Committee concurred in the recommendation
of the Department of Public Works and adopted a motion
recommending tha.t the City Council direct the City
Attorney to withdraw a petition filed with the Minnesota
Public Service Commission, the said petition requesting
that the previous order of the Public Service Commission
be amended so as to allow Alton Street to remain open
at its crossing with West Seventh Street.
I have prepared and submit for your consideration a
Council resolution which would ratify and confirm the
actions of the Public Works Committee. Please notify me
if the resolution is adopted so tha.t our office may file
the necessary withdrawal of petition with the Minnesota
Public Service Commission.
