WHEREAS, under authority granted by the Council of the City of
St. Paul by Resolution, Counci 1 Fi le No. 262251 approved September
26, 1973 as aa�ended by Resolution, Council Fite No. 262747 approved
December 14, 1973, the Department of Public Works issued a permit
to Foley Brothers inc. , 450 Endicott Bldg. , St. Paul , Minnesota,
55101 , to operate stone crushing machine ry pursuant to the provi-
sions of Chapter 462 of the St. Paul Legislative Code, in
connection with the construction of I-94 from Plum St. to Kennard
St, , known as State Project No. 6283-45 �94°392) ; and
WHEREAS, said Foley Brothers, inc. has been unable to complete
� Its stone crushing operations as originaliy proposed and desires an
extenslon of time; now, therefore, be it
RESOLVED, that the Council of the City of St. Paul does hereby
amend Resolutions, Council Fi31e;No. 262251 and 262747 by changing
the permit expiration date to February 28, 1974.

Dear Mayor Cohen:
Attached is a proposed Resolution pertaining to stone crushing
operations by Foley Brothers , inc. , the prime contractor for the
Minnesota Highway Department referenced project. The existing
Resolution-permit will expire on Janua ry 31 , 1974 and the contractor
has indicated that he will be unable to finish his stone crushing
operations by then due primaily to earlie r, adverse weather con-
ditions.
Foley Brothers has been crushing limestone rock and existing
concrete from old walls, under proper permits , since March, 1973.
Since the Department of Pubiic Works has received no complaints
to date on the stone crushing operations , we recommend that you
approve this Resolution for submission to Council as soon as
possible to encourage an expeditious completion of this work.
