Greenstein and the City of Saint Paul, a municipal corporation organized and existing under the laws of the State of Minnesota, WITNESSETH: l. An ancillary trust created pursuant to the last will and testament of Dorothy May Barnes is the sole owner of the premises at 766 Hague which is legally described as follows: Lot 7, Black 12, Nininger & Donnelly' s Addition to Holcombe' s Addition ` to Saint Paul. 2. James F. Greenstein is the duly appointed successor ancillary trustee of the ancillary trust pursuant to an Order of the District Court of Ramsey County dated January 3, 1973, File . No. 373292. 3. The City of Saint Paul has determined, by Council File N�. 261702 and after a public hearing, that the structures on the above premises are hazardous buildings within the meaning of Minnesota Statutes 463. 15, Subdivision 3. 4. James F. Greenstein acknowledges receipt of a copy of the above council file and concurs in the finding� and determi- nations set forth therein. � � �.� . d - • 263�3'7 5. By letter dated January 14, 1974, a copy of which is attached as Exhibit A, Thoma.s R. Burke and the Oma.ha National, trustees under the last will and testament of Dorothy May Barnes, have agreed to permit the razing of the : structures on the premises at 766 Hague. b. James F. Greenstein agrees to permit the City of Saint Paul to enter the above premises and raze and remove all structures thereon, pursuant to Minnesota Statutes 463.151, and accordingly, assess the cost of such razing and rernoval against the real estate above described. The proceeds which you remitted at that time have been deposited equally to the two beneficiary accounts. In response to your question regarding property located at 766 Hague, The Omaha National Bank, as Trustee, of the above referenced Trust has no criticism or di,f�ezence with the conclusion of the Minnesota Trustee with regard to the razing of this property.
