Ficker SU&7ECT: Claims of Freda Driscoll and Jean Osteraas T'he claim of Freda Driscoll arose out of an incident on May 8, 1973 when she suffered a sprain and contusion of her right foot and ankle and twisted her neck as a result of stepping into a hole in the east crosswalk on 7th Street at the intersection of St. Peter and 7th Streets. She incurred medical bills of $52 .00 and complained of pain from the injury as late as December, 1973. It is my opinion that the City would be held liable for the injury. The claim of Jean Osteraas arose out of the loss of her coin collection by the Department of Police on July 8, 1971. The police department had taken possession of the coin collection on December 16, 1969, and held the collection until the coins were lost by placing them in a trust account on July 8, 1971. The coin collection has been appraised by Dayton' s coin expert at $7,831.96, and by another appraiser at approximately $6,900.00. Miss Osteraas has evaluated the coin collection at over $8,400.00. It is my opinion that a bailment contract arose at the time the City took possession of the coin collection, and the City is liable for its failure to return the coin collection to its rightful owner.
