WHEREAS= ThE Council of the City of Sain� Paul, by Resolution
C. F. 262591, approved November 23, 1973, approved the vacation of
a portion of Pierce Butler Route, a portion of Seminary Avenue, and
a portion of Milton Street, as more fully described in said resolu-
tion, subject to the reservation by the City of an easement for
sewer purposes over that part of the vacated streets which lie within
a strip of land 60 ft. in width, being 30 ft. on each side of the
North line of ,the said Southeast qua.rter of the Southeast qua.rter of
the Southwest quarter of Section 26� Township 29� Range 23; and
WHEREAS, The Council, by Resolution C. F. 263243, approved
Ma.rch 15, 1974� and upon the petition of the Housing and Redevelop�nent
Authority of the City of Saint Paul, did waive certain ret�ined ease-
ments on beha.lf of the City and other utility compa.nies within the
streets as vacated by the City Council through its Resolution C. F.
262591; and

WHEREAS, The waiver of such retained utility easements should
ha.ve been subject to the continued retention by the City of Saint
Paul of the sewer easement as reserved in the vacation of street
resolution, C. F. 262591; now, therefore, be it
RESOLVED� That the Council of the City of Saint Paul does hereby
amend its previous resolution� C. F. 263243, so as to waive retained
easements contained in Resolution C. F. 262591; subject, however, to
the retention by the City of Saint Paul of an easement for sewer
purposes over tha.t part of the described land set forth in said ,
Resolution C. F. 262591 which lies within a strip of land 60 ft. in
width, being 30 ft. on each side of the North line of the said South-
�� east quarter of the Southeast qua.rter of the Southwest quarter of
Section 26� Township 29, Range 23, subject to the terms and conditions
pertaini.ng to the permanent sewer easement as set forth as Condition
No. 2 of the said Resolution C. F. 262591 which conditions rohibit

FURTHER RESOLVED, That the City Clerk is hereby directed to
file a certified copy of this amending resolution with the Register
of Deeds and the Registrar of Titles in and for Ramsey County, Minn.

Re: Waiver of ea.sements - portion of Pierce Butler Route
Housing & Redevelopment Authority
The retention of a se�wer easement over a portion of Pierce Butler Route as
requested by the Department of Public Works was inadvertently omitted f`rom
the original resolution waiving the retention of utility easements.
The attached resolution amends the original resolution to effect this change;
therefore, I recomrnend the atta.ched. resolution be approved by the Mayor for
submission to Council.
