Resolution Approving Service Levels For The 2003 Right-Of-Way Maintenance Program
WHEREAS, the Mayor's Proposed 2003 Budget for the City of Saint Paul included a net
spending plan o£ $23,244,622 for the 2003 Right of Way Maintenance Program in the Street
Repair and Cleaning Fund 225; with a proposed fmancing plan that included special
maintenance assessment revenues of $14,756,000 and use of fund balance fmancing of
$2,695,479; and
6 WHEREAS on October 21, 2002 the Real Estate Division mailed to all Saint Paul properly

owners a Public Hearing Notice for the 2003 Right-Of-Way Program; with the public hearing
being before the City Council on November 6, 2002. (A copy of the public hearing notice is
attached for reference.) Each notice included an estimate of what the property's special
assessment for 2003 Right-Of-Way Maintenance wark was proposed to be. The estimated
2003 special maintenance assessment would be payable in 2004 (it would be itemized on the
2004 real estate statement unless the property owner decides to pay the 2003 special
assessment in December of2003.) The estunated special assessment for 2003 Right-Of-Way
Maintenance was based on the attached Public Works Departinent's report titled "SCOPE OF
WORKiJNIDER 2003 RIGHT-OF-WAY MAINTENANCE PROGRAM" dated October 18,
16 2002, which identified proposed per-foot assessment rates for each class of property, based
17 on the service levels proposed for each property class. The sum of all estunated 2003 Right-
18 Of-Way Maintenance Special Assessments totaled $14,342,301 for all Saint Paul properties
19 being notified; and
20 W�IEREAS, the City Council held the "2003 Right-Of-Way Maintenance Program Public
21 Hearing" on November 6, 2002 in the Council Chambers; and the City Council and Mayor
22 heard public testimony opposing the proposed large percentage increase for the 2003 Right
23 -Of-Way Maintenance special assessments; and
24 WI IEREAS, after the November 6, 2003 Public Hearing, the City Council considered various
25 spending and fmancing adjustments for the 2003 Right-Of-Way Maintenance Program, in
26 order to find a way to reduce the size of the proposed increase for the 2003 special
27 assessments for Right-of-Way Maintenance. During the Council's budget deliberation
28 process, the Mayor recommended a revised 2003 Right-Of-Way Assessment Plan which

1 would reduce spending by $600,000 and lower assessment increases to approximately 35%.
2 When adopting the City's 2003 Budget, the City Council decided to cut the proposed
3 spending plan for the Street Repair and Cleaning Fund 225 by $1,300,000, and adjust the
4 proposed fmancing plan by recognizing an additional $560,000 in revenues, increasing the
5 useoffundbalanceby$1,530,598,recognizinga2.7%AssessmentDelinquencyAdjustment,
6 and by reducing Assessment Billings by $2,658,023. Attached is the "City Council Adopted
7 2003 Budget For The Street Repair and Cleaning Fund 225" and the "The 2003 Right-Of-
8 Way Maintenance Assessment Rates And Revenues: Based On Adopted 2003 Budget"; now
9 therefore,
10 BE IT RESOLVED, that the City Council of Saint Paul does hereby determine that the
11 Right-of-Way Maintenance work to be performed within the City of Saint Paul in 2003 shall
12 be in the manner as set forth and described in the attached Public Works Deparl�nent's report
13 titled "SCOPE OF WORK LTNDER 2003 RIGHT-OF-WAY MAINTENANCE PROGRAM"
14 dated October 18, 2002; and that the appropriate City Depa.rhnents are hereby authorized to
15 perform the necessary maintenance work as set forth in said report; and
16 BE IT FURTHER RESOLVED, that the appropriate City Departments shall, in accordance
17 with said Chapter 62 the Administrative Code, keep an accurate record ofall costs attributable
18 to 2003 Right-of-Way Maintenance Program, and report such costs and resulting assessment
19 fmancing information to the Real Estate Division of the Deparhnent of Technology and
20 Management Services far the calculation of a fina12003 Right-of-Way Maintenance
21 Assessment billing in the fall of 2003.

SCOPE OF WORK UNDER 2003 RIGHT OF WAY MAINTENANCE ASSESSMENT
The purpose of the Public Hearing is to consider the level of service for Right of Way maintenance to
be performed in the City of Saint Paul in 2003 and to consider the cost of such seroice to be assessed
against benefited property in accordance with Chapter 62 of the Administrauve Code.
The particulaz service to be performed and the estimated costs as proposed by the appropriate City
departrnents are as follows:
CLASS I-A - DOWNTOWN STREETS
Descrintion:
Class I-A service will be performed on all docvntown streets (face of wrb to face of curb) within the
following boundaries: Kellogg Boulevard on the south and west, Eleventh Street on the north, and
Broadway on the east (except streets listed in Class I-B, Downtown Streets (Brick)).
Pronosed 2003 Level of Services:
The downtown streets will be swept three times per week and flushed five times per week. All
routine maintenance, including patching, repairing of street surfaces, tree trimming, and snow
plowing w11 be performed on an as-needed basis.
Pr000sed Assessment:
All Class I-A service will be assessed at a rate of 7.95 per assessable foot for all.
CLASS I-B - DOWNTOWN STREETS -- BffiCK
Descrintion:
Class I-B service will be perFormed on all the following downtown brick streets (face of curb to face
of curb): St. Peter St., from Kellogg Blvd to Sixth St.; Wabasha St., from Kellogg Blvd to Sixth St.;
Fourth St., from Wabasha St. to Market St.; Nlarket St., from Kellogg Blvd to Sixth St; Fifth St., from
Wabasha St. to Market St.; Sixth St., from St. Peter St. to Wabasha St.; and Washington St, from
Kellogg Blvd to 4th St.
Prouosed 2003 Level of Services:
The above listed downtown brick streets will be swept three times per week and flushed five times per
week. All routine maintenance including patching, repairing of the brick surfaces, uee trinuving, and
snow plowing will be performed on an as-needed basis.
Provosed Assessment:
All Class I-B service will be assessed at a rate of 9.95 per assessable foot for all.

CLASS II- OUTLYING CONIMERCIAL AND ARTERIAL STREETS
Descriprion:
Class II service will be performed on all outlying commercial and arterial sueets in the City. These
are the major arteries in the City and have both heavy volumes of vehicular and pedestrian tr�c and
have frequent business or commercial properties fronting on them. Typical examples would be as
follows: University Avenue, Snelling Avenue, West Seventh Street, East Seventh Sueet, Rice Street,
Payne Avenue, Arcade Street, Summit Avenue, Grand Avenue and others. All of these Class II streets
aze accurately defined on a map available for viewing in the Deparhnent of Public Works, 9Q0 City
Hall Annex.
Proposed 2003 Level of Service:
The Class II streets would be cleaned approximately 13 times per season. All routine maintenance
including patching, repairing of street surfaces, sidewalk maintenance, right of way tree maintenance
and trimming, and snow plowing will be done on an as-needed basis.
Proposed Assessment:
Under Class II service there will be two assessment rates, one commercial and one residential. The
commercial property rate will be 4.35 per assessable foot and the residential property rate will be
2.10 per assessable foot.
CLASS III - ALL RESIDENTIAL STREETS
Descriotion:
Class III service would be performed on all residential streets including oiled streets, paved streets
and intermediate type streets.
Pr�osed 2003 Level of Service:
Residential streets, including oiled, paved and intermediate streets, will receive a thorough cleaning in
the spring which includes sweeping and flushing. Patching, repair work, sidewalk maintenance, right
of way tree maintenance and trimming, and snow plowing will be done on an as-needed basis. To
further improve service and efficiency, a new chip sealing policy became eFfective in 2000: All
residential streets (oiled and paved) will be clup sealed on an 8 year cycle. One-eighth of these
residential streets (a total of 64 miles) will be chip sealed each year. In the fall leaves will be
picked up from these streets.
Proposed Assessment:
Under Class III service to residential streets, we have two assessment categories. The commercial
property rate would be 3.30 per assessable foot and the residential property rate would be 1.80 per
assessable foot.

CLASS IV - ALL OILED AND PAVED ALLEYS
Description:
Class IV service would be performed on all oIled, paved and intermediate type alleys within
the City.
Pr000sed 2003 I.evel of Service:
All oiled, paved and intermediate alleys will be swept during the season. All routine
maintenance, inciuding patching and repair of the alley surface, will be performed on an
as-needed basis. To further improve service and eFticiency, a new chip sealing policy
became effective in 2000: All residential streets (oiled and paved) will be chip sealed on
an 8 year cycle. One-eighth of these residential streets (a total of 64 miles) will be chip
sealed each year.
Proposed Assessment:
The proposed assessment rate is .86 per assessable foot for commercial property and .57 per
assessable foot for residential property.
CLASS V - UNIMPROVED STREETS
Description:
Class V and service will be performed on unimproved streets. By unimproved, we mean
those streets that have not been developed far one reason or another. They aze platted City
rights-of-way; however, the abutting residents have never petitioned for their improvement
nor have there been any assessments levied. Because they aze City rights-of-way, the City has
the responsibility to perform minimal repairs and maintenance work to reduce hazazds.
Proposed 2003 Level of Services:
The maintenance and repair of these streets will consist of patching, minor blading, placing of
crushed rock and other stabilized material, right of way tree maintenance and trimtning, and
snow plowing in order to make them passable and reduce hazards.
Pr�osed Assessment:
The proposed assessment rate on unimproved streets is 1.92 per assessable foot for
commercial property and 1.14 per assessable foot for residential property.

CLASS VI - UNIMPROVED ALLEYS
Description:
Class VI service will be performed on unimproved alleys. By unimproved, we mean those alleys that
have not been developed for one reason or another. They aze platted City rights-of-way; however,
the abutting residents have never petitioned for theu improvement nor have there been any
assessments levied. Because they are City rights-of-way, the City has the responsibility to perform
minimal repairs and maintenance work to reduce hazards.

The Ciry has not increased its summer street maintenance assessment for over ten years. In order to continue to
provide services within the City right-of-way without raising properry taxes, the Mayor has recommended a Right-Of-Way
maintenance assessment which will help finance part of the cost of maintenance within the City right-of-way. This Right-
Of-Way assessment will include the old summer street maintenance assessment in addition to an assessment for winter
, street maintenance, boulevard tree maintenance and trimming, and sidewalk maintenance.
RIGHT Right-Of-Way Maintenance includes sweeping, flushing, patching, and chip sealing streets and alleys, patching,
OF WAY blading, and placing crushed rock on unimproved rights-of-way, street overlays, litter pick up, ordinance
MAINTENANCE enforcement, and emergency service, snow plowing including sanding and salting, snow removal, snow emergency
including tagging and towing, sitlewalk maintenance and repair, and boulevard tree maintenance and trimming.
In previous years the City's winier street maintenance and tree maintenance programs were paid by the City's
General Fund (properry tax money). This proposed Right-Of-Way Maintenance Assessment will ensure each
property which benefits from public right-of-way maintenance pays its fair share of the cost of the maintenance.
Property owners will continue to be responsible for sidewalk shoveling and boulevard grass mowing.
Remember... The City does not snow plow alleys.
QUESTIONS?
The cost of right-of-way maintenance in Saint Paul is about $21.3 million for 2003. Of this amount, the Mayor
proposes to collect approximately $14.3 million in assessments. The remainder comes from Municipal State Aid,
Trunk Highway Aid, County Aid, miscellaneous receipts, and General Fund contributions.

Description:
Class II service will be performed on all outlying commercial and arterial streets in t City. These
aze the major arteries in the City and have both heavy volumes of vehicular and p strian traffic and
have frequent business or coinmercial properties fronting on them. Typical exam es would be as
follows: Universiry Avenue, Snelling Avenue, West Seventh Sueet, East Seve Street, Rice Street,
Payne Avenue, Arcade Street, Sumuut Avenue, Grand Avenue and others. Al of these Class II streets
aze accurately defined on a map available for viewing in the Department of blic Works, 900 City
Hall Annex.
