An Administrative Ordinance Amending the Saint
Paul Administrative Code so as to Provide
Procedures for the Levying and Collection of
Special Assessments for Local Improvements .
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. Tha.t the Saint Paul Administrative Code be and is
hereby amended so as to add the following thereto to be coded as
Chapter 22:
CHAPTER 22 . LEVYING AND COLLECTION QF SPECIAL
ASSESSMENTS FOR LOCAL IMPROVEMENTS.
22 .01. (CALCULATION� REPORT. ) Following adoption
of the , Fina.l Order and completion of the p�a.blic improve-
ments uthorized, the departments involved sha.11 calculate
all of�their costs incurred in the making of the improve-
ments, iincluding construction costs, engineering,
inspec�ion and administrative costs� an�- s�ial� for�l�with
submit � such calculations to the Division of Assessments
and Valua.tions, Department of Fin,ance and Ma.nagement
Servic�s (hereina.fter referred to as Fina.nce Department) .
The Finance Department sha.11 then add to these costs all
expenses incurred by it in sending out notices, land ac-
quisition costs, and all other charges in.c�.rred �in the
ma.king of the public improvements . The Finance Department
sha.11 submit a written report to the Council setting forth
the total cost of the improvements, the amount of public
funds allocated to be pa.id by the City other tha.n the
amount, if any, which it will pay as a property owner, and
the amount to be assessed. In addi.tion to the report, the
Fina.nce Department sha.11 prepare a proposed assessment roll

which sha.11 set forth the recommended amount to be
assessed against each assessable lot, piece or pa.rcel
of land deemed to be benefitted from the improvement,
which proposed assessment roll sha.11 be maintained on
file and be open to public inspection in the Fina.nce
Depa.rtment.
22 .02 . (NOTICE, PUBLIC HEARING. ) Upon receipt
of the report and notice of filing of the proposed
assessment roll, the Council by resolution shall fix a
date for public hearing and sha.11 direct the Fina.nce
Depa.rtment to publish and ma.il the required notices of
public hearing prescribed by Section 14.01. 1 of the -' +
City Charter. For the purpose of giving mailed notice,
owners entitled thereto shall be those shown to be
such on the records of the Fina.nce Depa.rtment, but
other appropriate records ma.y be used for this purpose.
Notices sha.11 state the date, time and place of the
public hearings, the general na.ture of the improvement,
the area, and amount to be assessed against each parcel
of land, that the proposed assessment roll is on file
in the Fina.nce Department, and that written or oral
objections by any owner will be considered.
22 .03. (ADOPTION OF ASSESSMENT ROLL. ) At the
Council hearing on the proposed assessments, or at any
adjournment thereof, the Council sha.11 hear all persons
relative to the proposed assessments. Having heard all
persons, the Council may by resolution adopt the pro-
pos�d assessments, with or without amendments, as special
assessments against the lands named in the assessment
roll. Al1 assessments sha.11 be payable in equal annua.l
installments extending over such period, not exceeding
twenty years, as the resolution shall determine. The
assessments, with accruing interest, sha.11 be a lien
upon all private and public property from the effective
date of the resolution adopting the assessments .
22 .04. (NOTICE OF COLLECTION. ) Following adoption
of the assessment resolution and as soon thereafter as

practicable, the Finance Department sha.11 ma.il an
invoice to each owner of property na.med in the assess-
ment roll at the address set forth in such roll.
Failure to receive ma.iled invoices shall not invalidate
these proceedings. The invoice shall state the entire
amount of the assessment levied upon the particular
property, legal description thereof, the number of
installments applicable, and the fact that the entire
assessment or any number of installments may be pa.id
without interest if such pa.yment is received by the
Fina.nce Department within thirty days of the date of
the invoice.
22 .05 . (ANNUAL PAYNIENTS, INTEREST, CERTIFICATION
TO AUDITOR. ) Annual installments may be pa.id directly
to the Finance Department prior to the sixteenth of
November of each year. All assessments sha.11 bear
interest at the rate of six percentum per annum on the
rema.ining unpaid balance. Interest sha.11 commence
thirty days after the date of the invoice and sha.11 be
computed up to and including the date of payment or,
if certified to the Auditor as provided herein, inter-
. est sha.11 be computed up to and including the fifteenth
of November of each year. Any unpaid annual install-
ment together with accrued interest on the unpa.id
balance sha.11 be declared to be delinquent as of the
sixteenth day of November of each year and shall be
certified to the County Auditor by the Finance Department
to be collected by the County Treasurer in the same
ma.nner as are municipa.l taxes, and sha.11 be subject to
the same pena.lties, costs and interest cha.rges prescribed
by State law as are municipal taxes .
22 .06. (INTEREST-APPEALS. ) In the event an
assessment as to any piece of property in a public
improvement is appealed from in the ma.nner set forth
in Section 14.01.4 of the City Cha.rter, and not set
aside by the Court, the date from which interest sha.11
begin to run sha.11 be the same as governs those assess-
ments in the same public improvement not appealed from;

Section 2 . This ordina.nce sha.11 take effect and be in force

Re: Ordinance Governing Collection of Local Improvement
Assessments in Conformance with Section 14.01.6 of
the City Charter
Attached for your information and approval is a proposed ordinance
providing the manner in which assessments shall be collected and the rate
of interest to be charged, as required in the above referenced Charter
section.
The ordinance basically continues present policy while eliminating
the penalty feature which was always a thorn in the taxpayer's side. It
further provides for paying interest on the outstanding unpaid balance for
that period of time that the City is carrying the account, in much the same
manner followed in the business community.
This proposal has been a matter of interest to Mrs. Ruby Hunt, and
her office has been of assistance in the preparation of the ordinance.
Upon approval of the Administrative Branch of goverrnnent, Mrs. Hunt
has indicated that she would appreciate having the attaehed referred to her
for submission to the City Council.
