RESOLVED, That the Council of the City of Saint Paul� upon
recommendation of the Department of Public Works, does hereby
authorize acceptance of dedication of a perma.nent sewer easement
over a portion of Block 1� Cha.tsworth Street Addition, and over a
portion of the Northeast 1/4 of the Northwest 1/4 of Section 35,
Township 29, Ra.nge 23, as more particularly described in the Deed
of Dedication, a copy of which is attached hereto and on file in
the Office of the City Clerk; and the City Attorney is authorized
to record the Deed of Dedication in the proper office of recordation.

WARRANTY DEID
THIS INDENTURE, Made this °�1y.,�(day of �__ , 1374,
between AMHERST H. WILDER FOUNDATION, a non-profit c rporation under the
laws of the State of Minnesota, party of the first part, and CITY OF SAINT
PAUL, a municipal corporation under the laws of the State of Minnesota,
party of the second part,
WITNESSETH, That the said party of the fixst part, in considera-
tion of the sum of One Dollar ($1.00) and other good and valuable consid--
eration to it in hand paid by th� said party of the second part, the
receipt whereof is hereby acknowledged, does hereby Grant, Bargain, Sell
and Convey unto the said party of the second part, its successors and
assigns, Forever, all the tracts or parcels of land lying and being in
the County of Ramsey and State of Minnesota, described as follows, to-wit:
A permanent sewer easement on, over and across the
following tracts of land: -
Parcel 1: Those parts of Block l, C�ats*.�orth Street
Addition, according to the recorc�ed plat theraof, includ-
ing the vacated alley in said Block 1, which lie within
a strip of land 30 feet in width, being 15 feet on each
side of a center line described as follows: Commencing
at the Southeast corner of said Block 1; thence running
Westerly on the South line of said Block 1 a distance of
80.00 feet to the point of beginning of the center line
to be described; thence Northerly, parallel to the East
line of said Block 1, a distance of 126.00 f eet ta a
point; thence Northwesterly, deflecting 15° 15` 00" to
the left, a distance of 111.00 feet to a point and there _
terminating.
Parcel 2: The South 30 feet of the North 235 feet of the
East 185 feet of the West 218 feet of that part of the
West 1/2 of the Northwest 1/4 of the Northeast l/4 of the
Northwest 1/4 of Section 35, Township 29, Range 23 lying
South of the center line of Van Buren Avenue extended.
Parcel 3: The South 230 feet of the North 263 feet of
the East 3Q feet of the West 182 feet of the Norfih 1/2
of the North 1/2 of the East 1/2 of the East 1/2 of the
Northeast 1/4 of the Northwest 1/4 of Section 35, Town-
ship 29, Ra.nge 23. ,

ments and appurtenances thereunto belonging, or in anywise appertaining,

And the said Amherst H. Wilder Foundation, party of the f irst part, for '
itself and its successors, does covenant witih the said party of the second
part, its successors and assigns, that it is well-seized in fee of the
lands and premises aforesaid, and has good right to sell and convey the
same in manner and form aforesaid, and that the same are free from all
incumbrances except for mortgages of record running in favor of The First
National Bank of Saint Paul and the Public Utility Ea.sement in favor of
the Board of Water Commissioners of the City of Saint Paul, a municipal
corporation, granted by the Agreement dated June 3, 1974, by and between
Amherst H. Wilder Foundation, a non-profit corporation, and the Board of
Water Commissioners of the City of Saint Paul.
An� the above bargained and granted ia�ds and premises, in the
quiet and peaceable possession of the said party of the second part, its
successors and assigns, against all persons lawfully claiming or to claim
the whole or any part thereof, subject to incumbrances, if any, herein-
before mentioned, the said party of the first part will Warrant and
Defend.
